The case was dismissed and the terms of the probation were completed. I am now in the first year of the five year waiting period and am trying to get a job. On the employment application I was told that employers still look at the charge as a conviction. So would it be better to disclose it up front seeing as they will do a background check and and see the charge although it did not result in a conviction and the case was discharged or dismissed?

    News Flash: If you were on probation and the terms of the probation have been completed, YOU WERE ACTUALLY CONVICTED. You only received probation and if you did get prison time, it was suspended. If the case was dismissed, then there would have not been any probation at all.

    Yes, absolutely you must reveal this to your potential employer if they ask you about it. If you do not, and they discover it on their own, then you will be terminated immediately because you lied on your application. If you disclose it up front, you are almost always given the opportunity to explain the circumstances of the incident.
