The case was dismissed and the terms of the probation were completed. I am now in the first year of the five year waiting period and am trying to get a job. On the employment application I was told that employers still look at the charge as a conviction. So would it be better to disclose it up front seeing as they will do a background check and and see the charge although it did not result in a conviction and the case was discharged or dismissed?

I am a law student and have been charged with DUI (I know, not an ideal situation). I have an otherwise spotless record and am wondering the impact of a conviction on potential government employment–be it local, state, or federal. I have been accepted for an internship with the federal public defender’s office and am wondering if a conviction (or even arrest) will disqualify me. I was honest about the situation on my application form. Is a first DUI a disqualification from public sector legal employment? Thanks.

ok now I do have a background I got in trouble for a Public Intoxication and disorderly conduct and resisting arrest. I ended up spending the night in jail got out. Had to go to AA and community service and pay a fine. This was almost 5-6 yrs ago. This was the only time I ever ever got in trouble is this what they are referring to, I am not sure what it is I should do? Any help would be greatly appreciated. Thank You.

I have an interview on Monday and they are doing a full background check for a security clearance. I have a dui, evading, and arrest without conviction for a domestic. The dui is about 15 years old, the evading about 12 years old, and the arrest a little over a year old.

Hello, It has come to my understanding that juveniles in CA are able to seal their juvenile criminal records in CA when they turn age 18 OR if 5 years have past since the conviction. I know that we cannot seal our records if we committed an offense in WIC 707 (b), however, i ask this. Can juveniles still seal their records IF they got convicted with a FELONY rather than misdemeanor? Please help me, thank you for your time.

I was arrested 3 years ago. And had to stay in jail for a day while waiting for the bail. It was all because of grand theft misdemeanor case that has been dismissed after doing a pretrial diversion. The lawyer said there was an arrest but no conviction. will that arrest and case show on my record everytime they do a background check when applying for work? was there really no conviction on that case? do I need an expungement even if the case was dismissed?

I have been offered a job with BofA and was told that I need to do a fingerprint background check. I told that I have been arrested and that I was convicted, but that it was sealed off my record. Will the fingerprint background check still show the arrest and conviction? It happened about 6 years ago now. I am applying for a job in Japan and need a visa. The application form asks, have you ever had a conviction? Well I had a conditional discharge in 1997. I have never done anything since. The catch 22, however, is, should I say no. If I say yes, my chances of the job are gone because Japanese society is very conservative. I have a job interview at ross and i hear they do a background check. I have several misdemeanors/infractions on my record (i live in CA if that matters)…nothing major, no theft at least. Just one dui, one marijuana possession, one "alcohol possession at a beach, park, public area" conviction, and a resisting arrest. Will all of these show up on the screening you think? Would they frown upon this sort of behavior?

I was charged with a disorderly conduct in NY state in February of 2008. I pleaded not guilty and was a given an ACD. They said that I would not be charged with the crime if I stayed out of trouble for 6 months. I did so. Will the charge of Disorderly Conduct show up on my background check and should I disclose of it before hand? Also is it an Arrest & Conviction or a Minor Traffic Violation?

For instance if someone has a conviction of either grand theft or domestic violence for instance. When employers or anyone conducts a background check on an individual, exactly what information comes up. I know that the felonies will show up but will the felonies be explained in the check or would it be just in black and white.

I have a pending case that is going to be dismissed for 2 D Felony charges; I did not commit the alleged crimes. I’ve got a promising job coming up and they’re going to do a background check. Will this arrest/pending conviction show up? I wouldn’t hire someone with 2 D Felonies, but I’m innocent of this and its in the process of being dismissed!

About 5 years ago I got into a little trouble due to someone giving me a fake check, the conviction was expunged long story short. Last year I was offered a job with Wells Fargo bank & then they withdrew their offer after my background check didn’t pan through… How were they able to view this expunged record & what exact employer type has access to these "destroyed" records?
FYI, I was never arrested & also, I was specifically told that I would not have to check "yes" on an application to conviction. I’ve also already held federal & state positions without problem.

Will a "non-conviction case" show up on a background check in Washington State? If so, what are my rights if I am denied employment for a domestic violence charge that I am "not guilty" of and doing domestic violence classes instead. Unfortunately stupid choices in my teen years resulted in felony convictions for bad checks. This is not a representation of my current moral character and I have successfully held employment in both the financial and information technology areas since the conviction. I also have executive level management experience.
None the less, I find that in the current job market, the conviction seems to be more of an issue than previously. Any suggestions on companies that value the employee over the background check? I am willing to relocate nationally, and am willing to accept a lower starting salary to get my foot in the door. Any suggestions are appreciated.

i have a few convictions on my record when i was a youth.
its been nearly 5 years since my last conviction, all my charges i pleaded guilty to, my convictions are:
2x burglary & theft (dwelling)
1x theft from a motor vehicle
1x failer to surrender to custody at appointed time
& 1x breach of community & rehabilitation order
and since my last conviction ive worked a couple of jobs and been to college.
