I have just gained employment within Barclays Bank and they are now running through their background checks. I have 3 defaults on my credit file which I have been paying on time since they went on. Would this be a problem in passing my credit check for them? I have worked for them as a temp on a 6 months contract and since then my credit rating can only have gone better but this being a permanent position may be different?

Worried and nervous, PLEASE HELP!?
I was a young single mother who got way in over my head with credit. In a time frame of 2001-2003, I was extremely negligent. I am much more responsible with myself now. Unfortunately, bad credit does not come off over night. I am even putting myself into a financial slump by paying off all my bad debt. To me it is worth it though! I am paying for my carelessness with my bad credit everyday! My concern is that I recently got hired for a GREAT job. Everything a single mother could hope for. They are doing a background check. It is for an insurance job. I am working in the customer service dept. It pays AMAZING! I am not sure if they are doing a credit check with the background check. Should I talk to someone at my new job and risk opening a can of worms, or wait it out and see what happens and explain my poor decisions at that time if the need arises. I am so nervous because I dont know what to do. I need this job SO bad! Should I tell them or not? Please help.

I filed for Chapter 7 bankruptcy at the beginning of this month and last week I had an interview with a bank for a Universal Banker position. On Friday they called me and offered me the job and my salary and I accepted it. She said that they were going to do a background & employment check this week and I am supposed to start March 3. She did not say anything about doing a credit check, but can they take back their offer if they do see that I have filed for bankruptcy???

My current roommate is now showing her true colors, she is lying so much that it is ridiculous. She gave me 2 bad checks and she still haven’t paid her portion (security deposit and rent)..I told her because of this situation I want to do a background check because I am not comfortable with everything she is doing and saying..(lies after lies..)..She said she doesn’t the credit check and employment verification, but she will not sign for a criminal check. That was a red flag for me! Why would you not sign for a criminal check, is there something she’s hiding? Well of course there is, so I went online, typed in her name and DOB, and lord behold..she was convicted for IDENTITY THEFT AND WRITING BAD CHECKS AND MONEY LAUNDRING! Lord have mercy, I started crying..she could have gone into my room and took some info about me…I froze all my accts but still very scared.
So, In New Jersey, Is it illegal to do a criminal check without her permission. PLEASE HELP ME! MY LIFE IS IN YOUR HANDS!
The 2 checks came back as account closed and the accounts her in Maryland she claims, I asked her why can’t she open one in Jersey, she said she doesn’t have her social security card, but I remember seeing it when she pulled out her fake checkbook..my guess is that she is banned from opening accts because she might me in chex systems..WHAT A CROOK!…I WANT TO PRESS CHARGES SO BAD BUT HER BOYFRIEND IS PART OF A GANG HERE…MY LIFE IS AT STAKE…IM REALLY CRYING HERE BECAUSE I LOVE THIS PLACE AND I DONT WANNA MOVE…WHAT SHOULD I DO. My company sent me an employment disclosure and authorization form so that they can do a background check on me. The form says:
A consumer report or reports will be obtained on you for employment purposes. It may include an "investigative consumer report" that includes information as to your character, general reputation and personal characteristics. Under the Fair Credit Reporting Ac, you have a right to request disclosure of the nature and scope of the report, which involves personal interviews with sources such as employers, educational or training institutions you attended, references and law enforcement agencies.
Does this mean that they will be doing a credit check as well???

I filled out an application for a job today and had an interview. I signed a release to do a background/credit check. They asked for my date of birth on that release form. I left it blank. I havent been offered the job, I was only there for my first interview. I know that a backround/credit check can be done without a birthdate, and dont they wait until thett are least seriously considering hiring you, or have actally offered the position before a background check is done? Is asking for the birthdate on the other form just a sneaky way of finding out how old you are prior to offering you a job???
I realize they need the age info if you are hired, but I only filled out an application, and had a 10 minute interview.Isint it against the law to ask someones age before a job offer??Do the do background checks on everyone who fills out an application?

Hi Lawyers…Please HELP!
Needing some help please. I recently received a job offer for a Practice Management position after 3 months, 6 interviews and 5 references were provided. I was scheduled to sign contracts this week to begin working next Monday. However, the employer in a last minute turn of events, asked the recruiter to run an employment background check and credit check on me. The recruitment agency contacted me via phone and left a voice message asking for my consent to run these reports. I responded through email saying to go ahead but that I had a prior bankruptcy that occurred in 2005 that I felt sure would be an issue for the employer. The recruitment agency then called me to ask me if I was interested in divulging any details about this as they also felt sure she would "freak out" and have questions. I explained in brief that it was due to medical bills and opted to say no more.
I then spoke to my HR guru friend who told me that the law states any credit check has to be requested via a signed consent form. I quickly called the recruiter back to halt the process as I was also advised to not do it as these things are often very sketchy and not relevant. By the time I called to stop the process and state this was highly suspect, it was too late. The reports were run and the results related to the employer via a phone call. They assured me in a written letterhead document that no hard copy was sent to the employer nor had they kept the documents on file as they were not obtained legally and correctly.
As expected, the employer now is very upset by the bankruptcy. She feels she cannot trust her 2.5 million dollar practice to person with such a questionable history. That would be me. Yes, I’m furious and very very hurt. My background check is perfect..not so much as a speeding ticket. I’ve never been arrested, have felony convictions, etc. Nothing. Further, as previously stated, I have endured a marathon of 6 interviews and provided 5, yes 5 references..all stellar. She now wants to hold off on any decisions of employment pending some questions she now wants to ask me regarding the bankruptcy.
I am angry and feel discriminated against. First off, I understand that the collection of this data was not legally obtained. Further, I also know that asking me personal questions of this magnitude is also walking a thin line of legal correctness. If you can’t ask a potential employer if they are married or have kids, then how can you pry into their personal financial history and make that person justify themselves?
My question is obvious I guess: Do I have a legal case? And should the employer opt to forgo employment with me even though an offer was presented to and accepted by me, is this more of a case for discrimination?

@ WRG: Actually, no. It is not legal to attach credit check forms to applications for employment. This is a separate document that must be separately signed and a copy given to the applicant as well as kept on file in the employment office.
Further, I do not have bad credit, I have a bankruptcy 6 years ago. Nothing else is in question.
Finally, a verbal authorization does not preclude taking legal measures to ensure I am protected and the employer is protected. It’s a 3 part process: first is the signed form stating you understand a credit check might be performed. Then if the employer decides to pull the credit check, they must have an employee sign another statement giving consent, then if employment is denied based upon that credit check a copy of the credit report and a document stating the reasons why employment was denied must be given to the applicant. Verbal or not, it’s not legal.

Just wondering how employers can check your employment history? Other than them calling the employer of course. Because I lied on my employment before and a background check did not show my previous employers and got hired with no problem. The only other thing i can think of is a credit check? If so, can you please explain.

I signed permission to do a background check pre-employment. It is the FCRA background check. I have shady credit only because I had bankruptcy 3 years ago. I was told that cannot be a reason to not be hired.
What else may be checked? I have no criminal background but was fired from a job 16 years ago for illness/missed work.
My last employer said she has not heard from anyone yet and the application/FCRA background check permission was filled out online on 7/31.
I ran a credit check yesterday and there was no inquiry on it.

I believe I might just be paranoid because I don’t even know if the company uses a credit check as part of their background checking process, but if they do could it keep me from passing after they have offered me a position? It’s only a part-time sales associate position as well.

I had drug/criminal/fingerprinting/employment/credit check in progress. they told me it could be 1 – 2 weeks.

I am trying to find a job, and am worried about explaining gaps in my employment history, as well as being unclear on dates I started/ended jobs in the past. How in depth do the pre-employment background checks and work history checks go?
I worked a few months when I was 19, then I moved in with my fiance, and was basically a "homemaker", as he did not want me to work. I just handle housekeeping, cooking, paying bills, running errands. This was 10 years ago, and in the past 10 years I have been a homemaker. The only job i’ve had is "self employment" (babysitting and cleaning houses). I did take a temp job for a couple months back in 2006. Other than that, and the job I hate in ’99, nothing worth putting on an application. (Had a couple convenience store jobs over the years, but not long lasting, due to only having one car and having conflict with HIS hours.)
We now have a second vehicle, and I am DESPERATE to get a job outside the home! LOL
At least one place I am applying with does at extensive background check, including employment history and credit check.
I am wondering..
Can they verify the length of time you were employed with a company, and the EXACT dates? I called the restaurant I worked at back in ’99 to get the exact dates of hire and leaving, but they say they do not keep records past a few years. So, i’m not sure what the date were! Will the companies doing the background checks be able to find the info even so? If I just guess that the dates, will that look horrible?
Also, any advice as to how I should explain the huge employment gaps.
This is so complicated, any advice appreciated!

I was wondering two things. First, what is the purpose of a credit check for employment at places like WalMart? I understand background checks, but a credit check? Also, if I do not have good credit, does that mean I cannot be hired for places like this? I just really don’t get the point of it if everything else is fine why a credit check matters. I want to rent a commercial space and my landlord wants me to perform my own background/credit check. I’ve never had to do this before, as all my previous landlords did this for me. Is this landlord-to-be just lazy? Or is this normal? He also suddenly wants to raise the deposit, even though we agreed (verbally) on a lower price. Should I walk the other way?

My boss called me today and fired me because they did a background check on me. I have been working for them for a year already and employment was supposed to be subject to a background check and credit check. However, a year later, they fired me. Can I sue them and win?
Here’s the catch, they hired me as contract labor and had me fill out the tax form stating so when they hired me.

I filled out a rental application for a house, provided all the details necessary to do a background check (my SS#, DL#, etc) and paid an application fee. However, I forgot to sign the application because I was waiting to do so with the person I was working with, who wasn’t available when I dropped it off. They still went through with the background check though, is that illegal?
It did include a credit check. I have credit monitoring service and was notified.

I have a Ch 7 bankruptcy and am applying for a customer service call center position, does anyone know if there is a chance I will not get the job? They brought me in today to do paperwork and want me to start monday, but I guess it’s all contingent upon me passing the background check and drug test. I told the hiring manager that I did not have the best credit, and he did not seem concerned, he just said that HR handles all of that. The guy I shadowed in the hiring process said he had bad credit too and he had no problems, but I just didn’t know with the bankruptcy. Any help would be appreciated and spam is not.
they did say they would check credit, but most places do nowadays but it’s a general form so I’m wondering if this position really focuses on credit check as a part of the decision

I ask because I know that if a potential employer calls a former employer you were fired from, it is unlawful for that employer to give out that kind of information. Apparently, they’re not even allowed to give out the salary you made.
But, what I don’t know is if the company you were fired from releases the information–the fact that you were fired–to background check companies … or puts it in some sort of database that any background check company can access.
I’m really gearing for this one job and I don’t want to have that one job that I worked for more than 3 years ago to make me ineligible for this job. Any feedback is appreciated. Thanks.
I’m not asking if they call my past employer. I’m asking if it will show up on a background employment check. Ya know, those companies that do nothing but background checks on individuals for other companies for hiring purposes…
I’m also not asking if they check. I KNOW they check cuz an AT&T employee emailed me telling me which kinds of background checks they do: (county, federal, etc), a driving check, and an employment check. Those were his exact words.
I emailed him explaining that I was working with a credit agency which would show why I am delinquent on some of my credit cards. And he wrote back thanking me, telling me he didn’t think they did a credit check, but that they did the above ones.

I recently attended a group interview at toys r us. The manager stated that a criminal background check and a credit check were done. I have no worries about the criminal. I am worried about the credit check. My credit is going down the toilet. Not because I refuse to pay bills but because I have no income and can’t. I was already turned down by a call center and now I am afraid the same will happen now. I have a spotless employment record and absolutely no criminal record yet this report will deem me as untrustworthy. I have 2 year old medical bills and student loans that aren’t going anywhere. Without a job my credit will get worse. My question is how much would this affect their decision. Has anyone familiar with their hiring process. Any insight would be appreciated.
