I am an engineer and productive, "law-abiding citizen" living in Atlanta. Prior to 2000 I had no criminal record. In 2000 I developed a severe mental illness. Alone, I became progressively psychotic to the point I broke the law. In 2002 I plead guilty under the First Offender program and successfully completed probation in 2004. At that point the Judge issued an order dismissing the case. Shortly after completing probation, in accordance with instructions from the DA’s office, I submitted an application for expungement at City Hall East, the arresting agency, to clear/seal my criminal record from the public (but as I understood it not law enforcement). I was supposed to be called and advised my record was cleared but never was. Regardless, a few months after filing for expungement, I went to the Fulton Co. courthouse and pulled my criminal record. It came up clear and I thought all was well.

Approximately 2 years later I applied for employment and was hired pending a criminal background check. When the employer did a comprehensive background check, my full criminal history came up. Puzzled, I again went to the Fulton Co. courthouse to pull my record, and again it came up clear. Approximately 6 months after that I again was hired conditional on a background check with the same result.

The DA’s office is of no help (don’t get me started on those incompetents). Is there anything I can do to seal my record?

Yes, they are convictions.. they are misdemeanors. About nine years ago I applied for a job at a nursing home in Pennsylvania and this showed up. The person who interviewed me called me and wanted to meet with me to discuss this. I had already accepted another job and did not meet with her. I am not sure if she was going to offer me the job, even with seeing these convictions or not. At that point in time, it was only 6 years after the convictions. At the present time, these convictions are from 15 years ago, so I am hoping that they will not show up. All I can do at this point is hope I guess!

When a job’s ad say’s "the ability to pass a criminal background check " does that mean they will NOT hire you if you have a felony on your record ,no if’s and’s or but’s about it ?

I had a drug related felony (PCS) about 5 years ago , I did drug classes and the judge dismissed the case. I guess I was convicted then the class was my "sentence" .

As a condition of my employment, I have to submit to a criminal background check. I’m not opposed to that at all.

However, the HR person told me that I would have to pay for it, to which I replied "That’s a business cost of Huntington Learning Center – It is not my responsibility".

Once you have been fingerprinted in a police station will it come up on a criminal background check in a different county? I got offered a pretty good job in a different county from where i got booked and released, but they ask for fingerprints before they hire me. I work for a large hospital in Wisconsin and they recently decided they were going to send out a criminal background check survey to ALL hospital staff. They are claiming they are choosing to apply the four or five year background check required by the Caregiver law to ALL hospital staff. I work in IT and NEVER have patient contact. A lot of employers require the candidate "to successsfully pass a criminal background check", however, they are never specific as to what this constitutes. Of course, if you just did 10 years for rape or 20 years for murder, you’re not going to pass. Also, any prior felony conviction will usually be adequate to disqualify you.

But what about misdemeanors or ordinance offenses? Or felony arrests that did not result in conviction? Is it just really company policy when it comes to these less serious matters?

She informed me that when they do the Criminal Background Check for the U-4 with the SEC/NASD they only check back for the last 10 years. Does anyone know the specifics on this.

I was charged with a felony but got a Noli Prosqui, which basically got it off my records and I was never convicted but the charge itself I know is the only thing that can bar you from getting the security clearance for the U-4…which is forgery. I am praying it doesn’t come up.

when they do a background check for pre-employment at Home Depot, what information do they pull up? is it only a criminal background check?
do they see other jobs that you have worked in the past?

I have to take a Pre-employment criminal background check? If a person had a DUI 20 years ago, would the background check go back that far. It is for a Gov’t job at VA hospital. I don’t want to lie, but I also don’t want to mention stuff on my record 20 years ago if I don’t have to and if they don’t go back that far. I have heard it goes back 7 years? Anybody out there know?

I mean, if you think about it, everyone knows somebody that has been arrested. And everyone at the company that asks to pass a criminal background check has a clean record, I doubt it.

Am just curious for them do to a credit report do they have to have your permission for them do to a credit report check does it have to say on the appreciation that they will do it Is credit report includes background check I know if I get a high paying job they will call your former employers and reference and do a credit check if it a low paying job they just do a criminal background check on certain jobs It usually take a few days to a week for a criminal background check.

I know that most department stores and grocery stores conduct a criminal background check for anyone applying for a cashier position, but just wondering how many years back they go to see if you have anything more than minor traffic tickets.

Just curious…when a job offer is made contingent upon the successful completion of a criminal background check and favorable references from your previous employers, which would they complete first? HR professionals, I welcome your input!

One evening a woman who I never met or knew knocked at my door and said derogatory comments about me for not paying my rent, I told her I had visitors and it had nothing to do with her, she said “I am the landlords wife”. I went to go back into my house and she grabbed my wrist causing scratches, I pulled her hand off my wrist and she fell to the ground. (there were no real injuries to her or me) She called the police to have me arrested for assault so I called the police too for her assault on me. NOTHING HAPPENED no Police ever came.

Three weeks later the Police did come to arrest me for assault and to search my house for forged passports that the Landlord told them I had. (he lied) they took me to the station and took statements about the assault on the Landlords wife, bailed me for 1 month on police bail. Nobody took up my complaint about her assaulting me despite me complaining 2 times to Police, on the 3rd time at a different station they took my statement about her assaulting me. (this was 7 weeks after the assault)

My bail was up today and the Police Woman left a message that I should meet her so for the result from the Crown Prosecution service. She never showed up and left a note saying to come back in 1 more month pending investigations. She takes 1-2 weeks to return phone calls and if you miss her call she will not call again so I have to wait anoth 1-2 weeks. I have never been in trouble with The police In my life.

I also Have 2 jobs pending a CRB check (criminal background check) as I work with vulnerable Adults so this Police Woman is ruining my career by her mistreatment and incompetence. Who do I need to complain to about the way I have been treated.

I can’t believe that the Police never showed up and three weeks later expect to complete a full investigation long after the fact.

I think she is racist as I am from America and I am Black.

This case is Not about rent, it’s about an assault on myself that police failed to take action until forced to by me. The accuser got preferential treatment and the Police are not professional or timely for such a trifling matter that was just a spat. I accept that this is not racism as many people have now told me that the police in UK are totally useless with everyone. Too busy catching motorists and other easy prey. What is a good site to do a criminal background check on someone?

It has been close to 5 days now. I know the place I am applying is usually busy, and the to manager gets behind….so I don’t want call.

I am going for an expungement hearing in about one week. If I am granted the expungement, how long before a criminal background check does not see my conviction? Also, is there a list out there of all the government agencies that hold conviction information? I am in dire need of this to get off my record quickly!

Does a foreclosure show up on a criminal background check? I know it’s on my counties public records website and since it has to go to court will it show on a background check? Don’t have a bad criminal background at all,just losing our home through these bad times,and the landlord has to do a criminal background check,they don’t check credit,which I know foreclosure is on that. I want to do a thorough criminal background check on someone. I’ve already checked the local records but I need to access other states as well.

What is the best way to do this? There are so many online sites offering this but how do I know which ones are legit and the most thorough? I don’t mind paying as long as I know I’m going with a reputable and thorough company.

I applied for a job and was told they wanted to interview me, and was asked to send in more documents. A few of those documents will take me some time to get (such as the criminal background check) and I asked if it was okay if I sent the documents I already have first, and then send the other documents as soon as I get them.

This was all right, but I’m wondering what to write when I send the first bunch of documents? Would it be all right to write "Enclosed documents: …." and then below "Pending documents: …."

Or what would you write?

My rented flat was burgled while I was away on holiday. The estate agent asked for permission to install a new, more secure door. I gave them permission to install the door while I was at work. When I got home that night I noticed that my laptop was missing. I asked them about it and they said they couldn’t explain what happened and that the people who installed the door were trusted contractors. I called the police and they interviewed both individuals. After the interviews the police served a search warrant on the nephew’s flat, but did not find the laptop. The police told me the nephew has prior convictions for theft, and that’s why they were able to obtain a warrant. I don’t want to file another claim with my contents insurance company after having filed one a few weeks ago. What I really want is for the estate agent to compensate me for my stolen laptop. Do I have any recourse, legal or otherwise? Do estate agents have a responsibility to obtain a criminal background check on their contractors? Thanks…

I use a bus service to get to school. The bus company is a disgrace and the conditions of the buses can be terrible. The drivers often swear at other drivers and, in some cases, at the pupils. They use their mobiles while driving, which is now illegal in England, and use foreign workers ( i have nothing against foreign people, it’s just that sometimes they don’t understand you and therefore do not stop at your stop).

However, recentley, one of the bus drives was arrested for selling pirate DVD’s. Since then, he has been allowed to drive about 50 children to school. My question is:-

Am i allowed to use The Freedom of Information Act (2000) to find if all the drivers have been security checked/criminal background check (CRB) to see if they actually have been safety checked or even to use the act to know information which can be damaging? (damaging as in safe to work with children)

The reason is im writing a letter to my council.

I am a Mexican citizen. In the 90′s I lived in Argentina and back then I was stupid and comited a crime for which I was sentenced to several year that I served and got released. Now I am happily married and living in Dominican Republic. Now I want to get the Dominican citizenship but first I have to sign a document declaring that I have never been arrested or sentenced for any crime in anywhere in the world, and in case that I lie in my declaration and they find out, I can get up to 3 years for lieing in an official document. I know that once I apply for the citizenship, they do a criminal background check through Interpol. What shoud I do? Do you think that I will apear in Interpol’s database?
