Im trying to get a job with an insurance company. The job responsibilities will be processing auto insurance claims, They will be doing a background check. I have a clean criminal history, employment history and i dont even drive to have a driving record The only thing is I have 2 past due accounts on my credit report, will i still be offered the job? or will they withdraw their offer

I am an engineer and productive, "law-abiding citizen" living in Atlanta. Prior to 2000 I had no criminal record. In 2000 I developed a severe mental illness. Alone, I became progressively psychotic to the point I broke the law. In 2002 I plead guilty under the First Offender program and successfully completed probation in 2004. At that point the Judge issued an order dismissing the case. Shortly after completing probation, in accordance with instructions from the DA’s office, I submitted an application for expungement at City Hall East, the arresting agency, to clear/seal my criminal record from the public (but as I understood it not law enforcement). I was supposed to be called and advised my record was cleared but never was. Regardless, a few months after filing for expungement, I went to the Fulton Co. courthouse and pulled my criminal record. It came up clear and I thought all was well.

Approximately 2 years later I applied for employment and was hired pending a criminal background check. When the employer did a comprehensive background check, my full criminal history came up. Puzzled, I again went to the Fulton Co. courthouse to pull my record, and again it came up clear. Approximately 6 months after that I again was hired conditional on a background check with the same result.

The DA’s office is of no help (don’t get me started on those incompetents). Is there anything I can do to seal my record?

Any insight from some people about whether the Target background check does more than verify the employment you listed on your application?

1) How precise are companies when it comes to background checks? For example, if I was off a month when I did my employment dates for a certain position, would this be considered a ‘red flag’ to denial? (I simply ask because I am not 100% certain on the timeframe, and simply entered what I had typically used in my Resume. However I am unsure whether it was that month, or the next that my employment began.)

2) Are grades a reason for people to be denied employment? I included a semester of college in my background check wherein my grades were admittedly abysmal. Could this potential destroy my chance of being hired? (I didn’t receive any kind of degree, nor did I say I did on my background check information sheet.)

3) Your Opinion::: My background information should be almost exactly accurate, my employment dates (except for the note above) should be right on, along with my competency in the areas that I explained in my Resume. My High School grades were above-average, whilst college was far below average for the semester I was in there. No criminal history either; if a company has gone this far to check my background, what are my chances of employment? ((Unless grades are a HUGE factor when employment is decided.))

I am a college student from California pursuing a pharmacy career. I am interested in working in a hospital setting after I finish school. A couple years back I had a misdemeanor conviction for shoplifting (my first and last offense for the rest of my life). I have hired a lawyer and the case has been dismissed. Now with the advent of the Internet, more employers are screening applicants backgrounds than ever before. What I would like to know is how do hospitals generally conduct background checks? In other words:

1) Where do the hospitals get their investigation information from, i.e. what third-party screening vendors do hospitals use?

2) To what level and extent do hospitals examine an applicant criminal history, i.e. do they go back more than 7 or 10 years, do they look at misdemeanors, etc.?

3) Do conviction dismissals or expungements appear during the hospitals probing?

4) Have hospitals ever hire applicants with criminal records? If so, what was the nature of the offense that they considered forgivable (i.e. given a second chance)?

5) Should I disclose or lie about my dismissed conviction on a hospital job application?

6) I have heard some hospitals use "Live Scan" fingerprint services as their source for background screening. I thought only government agencies such as law enforcement maintain criminal record databases. How come the hospitals, a private sector, can gain access to them?

7) In California, does the 7-year limit of criminal disclosure law in employment background checks apply to pharmacist jobs if the conviction occurred more than 7 years ago? This is known as CA Civil Code (Consumer Credit Reporting Agencies Act) 1785.13.6.

Finally, for my situation, would I stand a chance of getting hired or be rejected if I am to apply for a hospital pharmacist position?

Any honest and accurate help or advice would be greatly appreciated since pharmacy schools are very expensive. I do not want to be burden with student loans that I am unable to pay back if I cannot get hire. Therefore, I prefer hearing from someone with experience in this area, i.e. people who have worked in the HR department for any major hospitals. Please include important details such as the location of the hospital, the laws pertaining to criminal background checks for that particular state/county/city, the ability to obtain a pharmacist license, and etc. The more relevant information that is available will allow me to make better personal decisions. I got a job offer at Wal-Mart and now I am waiting to hear back from them after they do my background check. I have no criminal history, but I am worried because they said they check past employment, and I stretched the truth a bit about how long I worked at one place because the place went out of business. Can they tell that I did this?
The reason I said I worked longer at this place is because the place doesn’t actually exist anymore… it was a small business and it’s out of business now… so they can’t be called but can they pull up all my past W-2′s and see that I didn’t work there as long?

A) If you do not dispute the identity of the arrest record in question, provide OFFICIAL COURT documentation on any and all arrest(s) and or conviction(s) in your past;

B) If you wish to dispute the identity of the arrest record in question, you may provide a set of original fingerprints. Call xxx-xxx-xxxx to obtain a fingerprint card and and return envelope from the office which you applied.

ok now I do have a background I got in trouble for a Public Intoxication and disorderly conduct and resisting arrest. I ended up spending the night in jail got out. Had to go to AA and community service and pay a fine. This was almost 5-6 yrs ago. This was the only time I ever ever got in trouble is this what they are referring to, I am not sure what it is I should do? Any help would be greatly appreciated. Thank You.

An arrest was reported on my background check for employment. It is true that I was arrested nearly two and a half years ago for a dui, which is what the report shows. However, it is inaccurate that the status of the case is waived, which is what the report shows. This gives the false impression that I am in the process of being sentenced.

In fact, the status of the case that they used for their information is from the preliminary hearing at the magisterial level, shortly after my arrest in 2007. The online document clearly shows the case disposition (dated 1/2008) as waived, and the status of the case as adjudicated, or closed, because it was waived at that time to the court of common pleas. In case anybody hasn’t noticed, this is 2010. Does it take two years to go to court for a dui? In any state?

At the courthouse level there is no record of my case. It was expunged after successful completion of ARD. For some reason, there is a glitch in the system, which I am currently in the process of trying to get corrected, so that this information is no longer available for public consumption and misinformation.

The second error is a "possible match". It’s someone who shares my first name only, shares my birth date, and lives in a state I have not visited since I was an infant. I hardly think I could have been capable of doing anything criminal when I was 11 months old.

I am 99% positive that this purveyor of misinformation (aka, the credit reporting agency — now there’s a possible match!) did not use the social security number that I provided to fact check my criminal history before releasing said misinformation to my possibly soon to be ex-potential employer.

How do I dispute these? I’m not sure that I want to forward a copy of my court order for release, dismissal and expungement (for privacy reasons) to a company that is so careless about the information they distribute, all the while including a disclaimer about it’s reliability and accuracy, and at the same time denying any responsibility for said unreliable and inaccurate information. If I performed that poorly at my job, I would have been fired a long time ago!

Is it up to me to prove that the information on my background check is inaccurate and incomplete, or is it up to the credit reporting agency?

If so, how do how "prove" that I am not the complete stranger that they are suggesting that I am?

I know its the holidays, so I’m trying not to worry. But I went for my physical, drug test, background check on december 15th and today is january 6th! My drug test I passed and my physical was good. I have no criminal history, but am wondering are they still wanting me to work? I want this job so so bad! My daughter recently saw her employee record and pre-employment background check. It listed her as HIGH RISK. She has a perfect credit history, college degree, excellent employment record and no criminal history. She phoned the background checking agency and asked why. They responded that she is HIGH RISK because she is my daughter and when I went through a life challenging health challenge and became disabled, I had to file for bankruptcy. Because my daughter was living at home at the time of my illness / bankruptcy, they say that makes her HIGH RISK. My health crises and bankruptcy should have NOTHING to do with my daughter’s life. Is this legal? If not, how do we fix this? Who knows how many jobs she has been denied because of the false HIGH RISK status!
She does not live with me. She has had two homes since this happened and nothing has changed this negative report. It simply cannot be legal for an agency to assign blame to one person for another person’s actions. If I committed murder, you wouldn’t also go to jail just because we lived together. If my current landlord files for bankruptcy, it has NOTHING to do with me. A child cannot be responsible in any way for their parents financial collapse due to a near death health challenge.

I already had two interviews for the same company. The second one was the final one. At what point does HR perform background checks? Besides criminal history, credit reports and employment verification, what other information do HR background checks consist of?

My brother’s ex-girlfriend recently moved to Florida to be near her sister. My brother is a real jerk and really took advantage of her and made her life a misery. She is having a hard time finding a job. Someone told her that pre-employment background checks generally include a credit report and from what I’ve read on here that seems to be true. Her credit is lousy, really bad, partly thanks to my brother, he took terrible advantage. Can anyone in Florida think of some places that don’t do extensive background checks? She has no criminal history, but she hasn’t worked in several years and doesn’t have alot of job skills, either. She’s also almost 50 years old. She’s filled out several apps., but no callbacks. How about grocery stores? Wal-Mart? Any ideas? I don’t want to see her cave in and go back up North.

I was arrested for hot checks in 1990. I paid the restitution. Now I am applying to work for the school district. The application asks for criminal history. I have never been in trouble with the law except for that one instance. Do I give this information? If I do not, will the district not hire me for the mistake I made 20 years ago, as a young person?

In MI, you can go to michigan.gov and select the OTIS (Offender tracking information system) link from the home page. Here, you enter the persons name, birthdate, race, tatoos or any other markings and submit. A list of all the matches will load. Select the record you want to view. Many have pictures with info about their criminal history and probation restrictions. I would suppose this is available in other states as well.

I applied for a job yesterday that required a background check. I was wondering if jobs I had before I turned 18 will come up? I don’t have anything to hide, but I didn’t list one of the jobs I had in high school because the experience I gained there didn’t pertain to the job I was applying for and there were only 4 spaces to list previous work experience so I chose to write down the places that were more like the job I was applying for. I just don’t want the potential new employer to think that I’m hiding something because I didn’t list it… if I had that job when I was 17 (started the job and quit the job when I was 17) will it come up on a background check? I’m 20 years old now, so it’s within 7 years…

I was offered a job at Verizon Wireless to be a sales consultant pending I pass a drug test and a background check. I know I will pass the drug test because I don’t and never have used drugs. But what all do they do in the background check? I know they will see if I have a criminal history but will they do a credit history check? I have had a motorcycle repossessed back in Feb 2010. I had 3 interviews during the hiring process with JCP. JCPenney offered me employment on the 3rd interview. She told me it will take 2 weeks for the background check results to come through. Tomorrow will make two weeks. I have no criminal history. I don’t know what’s hold up. Should I worry?

So here’s the deal… I applied for a job with Comcast awhile back. They called me in for the Assessment Test and I passed. Did the interview, pass. The lady from Human Resources called me in last Wednesday, 2/24, to do some more paperwork. While looking at all the paperwork she told me that this was a "preliminary" job offer pending drug test and background check/past employment verification. I had 48 hours to take the drug test but figured why not and took it around lunch that day. I have nothing to worry about on that end anyway. Then later that night, people from another company started calling asking for W2′s,1099′s, pay check stubs, diploma, etc. saying it was to check my employment verification. I sent it back in and one of my old employers called me about 2 days later and said they called his office and he left a good reference and all the info matched. Then an old client said they were trying to call her but she couldn’t answer because she was at work. They left a number for her to call and she would call it back but couldn’t get an answer. This went on for about 2 days. My HR lady told me that they drag their feet and it’d probably be 2 weeks before I could start. Here’s my thing though… Nobody has called me from Comcast or the company doing the background check. I can’t get in touch with either of them also. I have no criminal history whatsoever. If there is an issue would they at least call me to resolve it or just never call again? Or is no news good news? It has me kinda on edge. I guess from just sweating it out day to day and the fact that I have a 9 month old son and a fiance and this is the first good paying, legitamite job offer I’ve had since I got laid off last year. I was just offered a job by J.C. Penney, and they said the next step would be a background check. I have no criminal history, but on my application, I did alter the truth a little. 5 years ago, when I was 15, I was laid off from a job in about late mid-July. On the application, I wrote instead that I ‘returned to school’ in August. The place has since gone out of business however, so I was unable to provide contact information. Could they still find this out?

Hi – I was laid off from my job almost a year ago. It’s very tough out there and I’ve applied for hundreds of jobs. I went through my savings, assets, etc and coming down to the wire. Even with a college degree, the only place that offered me a position is at Blockbuster as store manager. I don’t care where, I just need a job ASAP. I was offered the position pending the background check. She said it would take about three days. It’s been five days now and I still haven’t heard anything.

So my questions is, what type of background check does BBV do? I have a clean criminal history. My credit is pretty shaky due to the lack of funds the past year. My former employee is a little peeved at me for claiming and winning an unemployment claim. I really need to get to work soon as the holidays are approaching quick and worried I haven’t heard back yet.

If they get it from your credit report, how can they be sure that the information is correct? My credit report only lists an address from 6 years ago and an employer from 5 years ago. Most of the background check is to verify employment history, criminal history, etc.

Recently been told of a small article about al cunningham, a death row inmate in San Quentin. Where would I look for a background into his criminal history?

I applied for an internal position at Kelly Healthcare – not a placement postion for a company they represent. They mentioned a background check which they state MAY include criminal, credit, education, prior employment history, driving record, etc..I have no criminal history, an excellent driving record, an excellent work record, average credit but I may have slightly exaggerated my education. Does anyone know how much of a thorough background check the company conducts? Do they really check all of these things even if you are not applying for a physician position or a position with requires credentials/licenses/certification? Thank you.

i have a friend who is fighting a criminal case against him. if he looses, it would go on as a criminal record. he has been working at the same place for past 6 years and the employer is aware of on going situation. do they have right to fire him incase he looses the case and has a criminal history?

Hello, I was just offered a very nice job working for a Telecom company baring a drug screening and background check. My most recent employer was a friend of my fathers and he paid me "under the table" for the 6 months I worked for him. I did not disclose this on my application (because it was not asked). The background check company says that it verifies employment/education/criminal history etc… Am i gonna be OK?? If they call my former boss he will totally vouch for me, but i am still very worried as this job pays nearly twice what every other job I am looking at right now does. I think you misunderstood me. I did put the job on my application and on my Resume, but if they try to confirm my employment using tax records, it isnt going to show up.

The third-party company they go through is called Sterling. I have no criminal history, so I am not worried about that. However, I am wondering if past employers that I did not put on my work history will show up? And what information will they obtain from my social security number? Thanks.

I would like to know if there is a way that citizens can look up the criminal history of another person for free. Counties have a free"right to know" website. Do states? I would like to know the specifics of the case also. I am in Ohio.

We have a neighbor that has a violent (non sexual) criminal history. Can we get information on this person for free on line? How? It is for the State of Oklahoma.

Does anybody know any Internet based background check servers that serve criminal history information to other smaller Internet background check retailers that get their information through those servers? For example, I know that ChoicePoint and LexisNexis are two Internet background check servers…anybody know about any others? Hmmm…10 points to the quickest answerer with the most responses. My husband just had a background check done for a job, and it came back falsified. All of the information he provided was correct. Birth certificate, social security card, name, work history, education history, etc. He does not have any felonies or any criminal history at all. What could have happened to make it come back falsified? We are really upset about it, because he is not going to get this job for unknown reasons.

My friend, who is a US Resident, recently got married and is trying to change her last name to her husband’s last name. On her 18TH birthday she got into some legal problems and earned herself a misdemeanor which she subsequently had expunged. I am aware that she has to inform immigration of this, even though she has had her records expunged, but what I am baffled about is what does her criminal history have to do with changing her last name to her husband’s last name? Can she actually be turned down because of her past activities? It is not as if she is petitioning for her citizenship or anything.
INS sent her a letter today informing her of her appointment date and requesting that she provide information, if any, on any arrests or criminal activity in the past. What bearing does her past activities have on her requesting a last name change and can her request be denied? She is concerned and thinking of just keeping her last name the way it is now that all of this is happening.
I can’t figure it out because I am not familiar with INS and their rules and regulations. I can figure out why a criminal record would be important to a request for Citizenship or Residency, but, no, I actually can’t figure out why her past criminal history would have a bearing on her accepting and subsequently using her husband’s last name. If last name could possibily be an issue then immigration should also have an issue with residents getting married. Getting married and accepting your husband’s last name are synomous with each other.

I just got into a Dealer school at a casino. You have to get a gaming license from the state before you can be on the gaming floor. Apparently they do a thorough background check. I have no criminal history or anything, but anytime someone says background check it can cause you to worry. What can cause you to fail a state background check? A police informant has made a false allegations against me.The police are bending over backwards to suppress his background and criminal history.I am told that even if this went to a jury they could hide this fact from the jurors but the judge could be told about the informant by letter but would also not disclose any details about the informant and would sit back and see a misccarriage of justice!I Is this correct and what are the safeguards against informants providing false evidence?
