for it to show up on a pre-employment background check? For instance……if someone was only employed for a company for 2 months would this show up?

I was offered a really great job, but the offer is contingent upon a pre-employment background check. I made a dumb mistake when I was 19, and received federal charges for it. Because I had never been in trouble before, I was allowed to enter pre-trial diversion. I paid a fine, and did community services, and the charges were dismissed. Will it show up in a background check? Do you think I should mention the situation to the potential employer before they do the check?

I’m starting a new job on Monday, and they need me to bring in my social security card to verify my eligibility for employment and make a photocopy of it for the IRS. However, I have 2 legal names, since I have an AKA on my certificate of naturalization. The last name is the same, but the first name is slightly different. The Social Security Administration has both names on file for the same social security number, as far as I can remember, because when I got my California Driver’s License, the CA DMV requires that the name on the license and a name associated with the given SSN match. However, since my original name is still legal, they did not issue me a new card. On top of all of that, I file my taxes using the legal AKA name that isn’t on my social security card.

I’m pretty certain that when they ran a pre-employment background check, the report found both aliases. Does it matter that my social security card has my original legal name and not my AKA that I currently use? Am I going to have problems when I go in on Monday?

Oh yeah.. I forgot to add, my driver’s license has my AKA name on it, not my original name.

I have a co-worker who wants to move in a certain income restricted apartment community. She works part time, and I’m assuming her boyfriend works full time. If they both fill out apps and put down that they are both employed, there’s a very big chance they will not get the apartment because the both of them together would make more than the restricted amount. So she put down on her application for the apartment that she’s not working. My question is, with income restricted apartments, do they do an employment background check on each applicant?

And will it come up on an employment background check?

My record has been squeaky clean for the last 4, almost five years. I’m damn sick and tired of not being hired because I have a theft charge from 5 years ago. So, What is "LONG-ENOUGH?" How long before it wont show up anymore? Just a regular employment background check, for easy to get jobs.

I have 4 driving tickets on my record, one for not stopping completely before turning on a red light, one for merging out of a right-turn-only lane, one for driving HOV, and one for running a red light.

I also fudged alittle on my resume, for a position I put "Intern" instead of "Summer Associate."

For my references, I put a co-worker down, but I never really worked directly with him, we worked in different departments.

Will this make me fail my pre-employment background check?
I do not have a criminal record, have never been arrested.
They’re not checking my credit history. They’re checking my education, employment (past 7 years), driving records, and criminal records.
The job is an Accounting position.
The company gave me a sheet of paper that had a bunch of items of a background screening and specifically checked what they were going to check. Credit history was not checked off. But it doesn’t matter anyway, i have a good credit history.

I told me co-worker about it, and he knows what to say as my reference.

Recruiters always ask me my salary and what I W2ed every after year. I tell the "normally" tell the truth about my salary but never about my W2. They always say they will ask for W2 to verify but they haven’t yet. I know there is a way fake W2s but is there any way an employment background check and verifythose documents.

I assume they can verify your salary but overall compensation year after year????? How far can background checks dig into your income?

They are aware I have an OUI but I forgot to mention I have other misdemeanors in the same class as the OUI I think, criminal mischief for breaking my boyfriends glasses, a disorderly conduct too. This is a pre-employment background check.

Needing some help please. I recently received a job offer for a Practice Management position after 3 months, 6 interviews and 5 references were provided. I was scheduled to sign contracts this week to begin working next Monday. However, the employer in a last minute turn of events, asked the recruiter to run an employment background check and credit check on me. The recruitment agency contacted me via phone and left a voice message asking for my consent to run these reports. I responded through email saying to go ahead but that I had a prior bankruptcy that occurred in 2005 that I felt sure would be an issue for the employer. The recruitment agency then called me to ask me if I was interested in divulging any details about this as they also felt sure she would "freak out" and have questions. I explained in brief that it was due to medical bills and opted to say no more.
I then spoke to my HR guru friend who told me that the law states any credit check has to be requested via a signed consent form. I quickly called the recruiter back to halt the process as I was also advised to not do it as these things are often very sketchy and not relevant. By the time I called to stop the process and state this was highly suspect, it was too late. The reports were run and the results related to the employer via a phone call. They assured me in a written letterhead document that no hard copy was sent to the employer nor had they kept the documents on file as they were not obtained legally and correctly.
As expected, the employer now is very upset by the bankruptcy. She feels she cannot trust her 2.5 million dollar practice to person with such a questionable history. That would be me. Yes, I’m furious and very very hurt. My background check is perfect..not so much as a speeding ticket. I’ve never been arrested, have felony convictions, etc. Nothing. Further, as previously stated, I have endured a marathon of 6 interviews and provided 5, yes 5 references..all stellar. She now wants to hold off on any decisions of employment pending some questions she now wants to ask me regarding the bankruptcy.
I am angry and feel discriminated against. First off, I understand that the collection of this data was not legally obtained. Further, I also know that asking me personal questions of this magnitude is also walking a thin line of legal correctness. If you can’t ask a potential employer if they are married or have kids, then how can you pry into their personal financial history and make that person justify themselves?
My question is obvious I guess: Do I have a legal case? And should the employer opt to forgo employment with me even though an offer was presented to and accepted by me, is this more of a case for discrimination?

@ WRG: Actually, no. It is not legal to attach credit check forms to applications for employment. This is a separate document that must be separately signed and a copy given to the applicant as well as kept on file in the employment office.
Further, I do not have bad credit, I have a bankruptcy 6 years ago. Nothing else is in question.
Finally, a verbal authorization does not preclude taking legal measures to ensure I am protected and the employer is protected. It’s a 3 part process: first is the signed form stating you understand a credit check might be performed. Then if the employer decides to pull the credit check, they must have an employee sign another statement giving consent, then if employment is denied based upon that credit check a copy of the credit report and a document stating the reasons why employment was denied must be given to the applicant. Verbal or not, it’s not legal.

I was arrested 5 years ago with an aggravated assault charge. I pled not guilty ( I was really NOT guilty) and the judge gave me a letter of release from the charges and I was not convicted, and the case was closed. I just had a pre-employment background check done from a college I want to work at, and everything is ok except this arrest record is showing up. They have given my info to corporate to investigate further. First I want to know why it is on my record when I was not convicted and released from the charges?? The second question–is it possible to still get the job with this? I asked the Admissions Director and he said it was out of his hands, and doesn’t look good because it is in Corporate’s hands now. I will be taking him the paperwork that proves my charges were dismissed and released from me. Will this help me? I really wanted this position!! Thank you all for your time.

My daughter recently saw her employee record and pre-employment background check. It listed her as HIGH RISK. She has a perfect credit history, college degree, excellent employment record and no criminal history. She phoned the background checking agency and asked why. They responded that she is HIGH RISK because she is my daughter and when I went through a life challenging health challenge and became disabled, I had to file for bankruptcy. Because my daughter was living at home at the time of my illness / bankruptcy, they say that makes her HIGH RISK. My health crises and bankruptcy should have NOTHING to do with my daughter’s life. Is this legal? If not, how do we fix this? Who knows how many jobs she has been denied because of the false HIGH RISK status!
She does not live with me. She has had two homes since this happened and nothing has changed this negative report. It simply cannot be legal for an agency to assign blame to one person for another person’s actions. If I committed murder, you wouldn’t also go to jail just because we lived together. If my current landlord files for bankruptcy, it has NOTHING to do with me. A child cannot be responsible in any way for their parents financial collapse due to a near death health challenge.

I recently got hired at a job on Wednesday of Last week(2-9-11) Im just waiting for my pre-employment background check before I can start. Here is the issue. I received a Letter today from the Courthouse saying I have a Warrant For My Arrest and the warrant was issued on 2-11-11. I immediately went down to the courthouse to figure out why, cause I havent done anything wrong. I talked to the lady and The warrant was issued because I havent finish paying my DUI class. She immediately Recalled the warrant and NO more warrant, issue solved. Now I am stressed out. I want this job so bad! Would it show up on my background check? and Should I call the employer tomorrow and tell her the situation? (The lady told me the warrant would be immediately off my background check)

I interviewed two weeks ago,. I felt like the interview went well. There were two positions were being offered. I was told by the interviewer, that I was more qualified for the xxx position rather than the entry-level position, which is a good sign, based upon background and experience. I was then asked to complete a pre-employment background check, in which I completed. They also told me that day, they are having two more interviews for the position. 3 interviewees for two positions are good odds. After the interview, I sent a thank you card, also followup with an email (a week ago) talking about if final decisions were made. The responded back telling me, that decisions wont be made till late next week due month ends. I am debating whether to call tomorrow, friday to see if decisions were made. Any Suggestions?

Today i was told by an hr person that they were going to do a background check on me. From what it seems in MA an employment background check seems to be different than an employer checking your CORI. it seems like most places that look up your CORI are places that work with kids, patients, elderly and there are specific consent forms requesting your signature of approval to look this up along with getting your social security #, etc. I was asked for none of this. What exactly comes up in an employment background check? I was arrested last spring for possible dui and i’m currently fighting it with a lawyer. Even my lawyer told me it’s usually just housing type places, gov agencies and places that work with kids that check a CORI. I’m annoyed because i only thought you’d have problems if you were convicted of something. I havent been…but looks like now i’ll have to worry about this damn arrest. My brother works in a court, i asked him to look up my cori and he said it just says, open cases. That could mean many things!

How can I do an employment background check on myself before I begin job hunting again? The business I used to work for went out of business, and I can’t find any references and most of my experience was in this company. So I need to do a background check to see if it comes up that I worked there. How do I do this? What companies should I contact to help me?

i was told that non violent felonies don’t show up for employment background check (unless they "really" dig or your running for city office). which is why some applications ask "have you been convicted of a felony in the last "x" yrs? is this true? i was convicted of a felony when i was eighteen, (eleven yrs. ago). i’ve been self employed since then but would really like to be employed full time. due i still have to put that i have a felony on all my applications?

i’m not saying that i would lie on my application, (i know that the dumbest thing u can do) but if there is some reason that that felony is not applicable then why mention it. also, i’m not saying that the felony is automatically erased from my permanent record (i know its there FOREVER), but just if the employer would see it.

oh..i also mentioned "some felonies" because obviously if it were murder or that nature than that would show up everywhere no matter how long.

I am planning on undergoing a standard pre-employment background check, non-government. I was wondering if dismissed/dropped charges will come up on the background. I had a small drunk in public charge that was dismissed in court.

I did a stupid thing once, shoplifting. The police wasn’t involved and i paid the civil demand. I know some retailers still put the info in the privately shared database. So, I am wondering if banks check this as part of their pre-employment background check? Is this information even legal to use against a new hire since it is not a public record.

I know the FCRA outlines restrictions as to how far back you can search in civil and criminal records when conducting a pre-employment background check, but I believe individual states also have their own guidlines. I would appreciate any help.

A friend was working in a company and got hired with no problem. Within about 4 months of being hired, he was offered assistant manager of the department. An in company promotion background check was done and something about his criminal record came up, and he was fired.

A pre-employment background check consent form WAS done.

BUT he had also denied having criminal charges on his application…

Was the company right in doing this?

I am dealing with an angry girl who is using the legal system and her friends to get back at me in what ever way she can. This nut job has now filed a Restraining Order and I have no desire to go near her yet I fear that if I do not try to stop the Restraining Order it will come back to haunt me when a potential employer does a pre-employment background check. Do Restraining Orders show up in the more common background pre-employment screenings? I do not work for the government, the police, or in a financial institution so I would not be going for any type of high end security clearance. Just want to know if a basic pre-employment background check will show any temporary or permanent Restraining Orders?

About three years ago a friend was put on a 5150 because she was in a blackout and acting weird after she took the sleeping medication Ambien. I just found out I have a worthless check charge from 7 years ago in Union county, North Carolina due to a routine employment background check. I have a letter from the complaintant that they have no record of this plus no one can produce the original returned check or a copy of it. My concern is I am due to start a new job and they advised me that they are going to rescind the offer of employment for nondisclosure.
I explained I couldn’t disclose something I have no knowledge of. I need advice on how I can remedy this with my new employer as the dismissed charges may not be sufficient.

Which I am not to sure about.

1. They didn’t offer me the job yet!
2. They didn’t tell me the pay! Said they couldn’t yet!
3. They want to check my personal bank acct info and credit background!
Which is a total mess now. Seeing I don’t work and haven’t since May and nothing is getting paid with no $$$ coming in…
4. This is a cell phone company that wants me to do this. Not a big chain one either. what would they need to know all this personal stuff about me for? This isn’t some goverment job! The really strange thing is they don’t even do credit checks for those that buy cell phones. they don’t even do contracts for there customers its cash or nothing.

I just got an conditional offer for a job today if i pass the background check! I am wondering if an arrest that i had 3 yeras ago and which was a petty theft but it was dissmissed however it will still show even though was dissmised ( i dont understand why ) would that have any effect on their decission and can they cancel the offer! The application asked if I have ever been convicted of a crime, "felony or misdemeanor". Then it states that havin a conviction doesn’t necessarily disqualify me from getting the job. It doesn’t state anything more about it.

If I exaggerated my employment on my resume by saying it was a few months longer than it really was, will this show up on my employment background check? Will it necessarily get me rejected from the position?
