i have a couple questions
how many or better yet what % of jobs and employers do criminal and driving background checks, or how often?
Does having a "No Contest" for a felony (no contest meaning you plead neither guilty or non guilty and were never adjudicated guilty) plea affect your employment opportunities for jobs besides government jobs? (example : Home depot or an Insurance agency)
Does having a suspended driving license also affect your opportunities even for jobs that do not require you to drive?

OK so Once again i was charged with possession of marijuana in 2003, i plead guilty to it and was put on felony probation for 5 years. I completed my probation in January 2009. My question is do employers who check your background look at the 2003 date (the date i was convicted) or The date i completed the probation period? This is important because if they look at 2003 it would be almost 8 years ago that i was convicted of the felony. But if they look at the 2009 date it would only be only 2 years, please let me know what u think employers look at when they look at your background check. Thanks in advance.

I interviewed for a job in a call center today, and will have the job, once my background check and drug test result comes back! I’m so happy about that! The only problem? That background check!
I am not a bad person, and certainly not a trouble maker, at ALL! But.. When I was 16/17 years old, I got into a bit of trouble. The most serious was underage drinking charges (one at 16, one at 18 and one at age 20) and fighting in public, which if I remember right, I had a couple under 18 and 2 after I turned 18. Other than that, I remember having a ticket for curfew violation, and some traffic tickets, nothing more. I haven’t been in ANY trouble since I turned 21. It’s been almost 10 years since I have had any trouble at all. Aside from a couple traffic tickets (not wearing a seatbelt a few years ago, that type of thing, nothing more serious).
This call center is doing an extensive background check, they told me to list anything, even speeding tickets. Wow! lol I honestly can not remember every ticket I have had in my life, and the dates. If I leave them out, will they not hire me if they find it? How far back to they look, do they go back before the 18th birthday? Am I going to NEVER be able to get a job in my life because of a few mistakes I made about 10 years ago? I’ve never had a felony, never had a charge for anything related to theft/fraud and the like. I don’t know what to think!
Oh, and I must add, the fighting in public charges all relate back to an issue I had with someone. He retaliated because he didn’t get what he wanted, and had his female friends pick fights with me, which I tried to avoid, but ended up getting into a few fights after trying hard to avoid it. A person can only take so much, until she has to defend herself. SO, it’s not like i’m a fighter, trouble starter. Very opposite! lol

I recently got a new job after looking for 4 months. I was finally happy and I finally started getting all my bills caught back up.
When I went into work today my boss pulled me aside and asked if there was anything on the application I lied about. I told my boss no and she said she has no choice but to terminate my employment because i failed my background check. She told me it came back saying I had a felony from 12 years ago on it.
First off I have never been arrested in my life. 12 years ago I would of just turned 18 and I did get a speeding ticket and a seatbelt ticket around that time but never anything like this.
Now after all that looking for a job and going through applications and interviews im back at square one and more pissed off than ever because its not true.
Do I have any recourse as too my options. Im more than willing to do whatever it takes to get this fixed and hopefully it can be fixed fast and get my job back.
Can I find out who gave my employer the incorrect info and sue them? Do I really have a case?
I really dont know what to do if anyone could steer me in the right direction it would really help.

This doesn’t involve me. Actually a place where a friend of mine works.
Her place of employment (a restaurant) recently started doing background checks on employees. All fine and dandy, if you are a new hire.. but they are also performing background checks on people who are employed (and long term) and have terminated some people because of the check.
No, my friend wasn’t one who was fired..
It just seems funny to have a retroactive rule like that. I trust companies follow rules and laws regarding this.. but this just seems funny. Do you think this is legal?

OK, more info through a text. One had a felony 15 years ago and has been employed for over 3 years. Another had a felony in 1998 and was terminated for it.
Yeah, criminals shouldn’t have done the crime in the first place, I get it.. But is it alright to go retroactive on things like this. Is there no ‘grandfather clause’ to protect people.

My husband was called by a potential employer for a pre-employment meeting regarding his background check. He had previously been given the job offer, already passed the drug screening. To our astonishment he was asked about a felony, that the Company they contracted to do the check, claimed they found, said it happened in Jan of 2001, stating it was a DWI with involuntary manslaughter that he was sentenced to serve 10 years, but only served 120 days. This is absolutely FALSE!!! My husband is an engineer and was in his senior year of college. We went directly to the Criminal Clerk of Courts and obtained a official sealed copy of his criminal record & w/only 1 small misdemeanor that’s from a traffic accident for failure to stop in 1994, thats all. Hes never ever, even had a DWI.
What in the world can we do to FIX this horrifying problem?

I am going through a background check for an airline.
I was arrested a few years ago when I was a minor. The crime I was charged with was a felony, but I was never convicted. It was instead reduced to a misdomeanor disorderly conduct. A few months after that, the entire record was expunged. I was told that it was off my record forever and I didn’t need to answer yes on applications where it asks if you’ve ever been convicted of a felony.
Is there any possible way that the airline can see this?

I just applied for a job and on the application it asked have you ever been CONVICTED not ARRESTED for any felony or indictable charges…i had possession of marijuana charge where i got a differed disposition and it was dismissed 2 years ago..i recently got arrested again about 2 weeks ago for possession of marijuana and my lawyer said it could be a class 1 misdemeanor i was just wondering if this would hinder my ability to get the job.

At a low in life I made a bad choice and was convicted of a felony. The felony was eventually reduced to a misdemeanor and then the misdemeanor was expunged. I need to see if it is really of my record so that I may truthfully answer on an employment application that I have not been convicted of a felony or misdemeanor.

I had a simple felony expunged but it is still visible on my record. I was told the process takes six months or more and I have an interview comming up soon. I do have the paperwork signed from the judge saying that my record is to be expunged. Should I present this to the company during the background process? Do you think that they will hold that against me still? My record says felon but the court order says expunged…..What shall I do ???? I applied for a job as a recreational aid at a senior citizen home and on my application they asked " In the past seven year have you ever been convicted of a felony." I checked no. I do have a Misdamenor for possesion under 20 grams and my desposition was community service. I have always been told if your honest on application your past will not be used against you. ( ANd I was ) But they did not ask me if I had any misdamenors, so I when my background check comes back I am sure they will see it b/c it is in public records, but they can’t hold it against be for not saying anything when technically they did not ask right ?

Im trying to get an apartment with my boyfriend. We will have the apartment as soon as they do a background check and employment verification. I went in and talked to a lady who handles the applications. I asked about the background check, as did my boyfriend when he talked to the landlord. We got into it bad when we were going through alot around 9 months ago, and i called the cops. I wasn’t in danger nor was i scared, just mad. We have since been through counseling and rarely get into fights anymore. We told the lady about what was on his record and how it would be gone in a few months because he got a plea deal to stay out of trouble for a year and he would have a clean record again. Im not sure whats on there, but there was talk of a felony at one point. I asked the secretary if it would be a problem and she said most likely no, and i said even if its still on there as a felony, again she said it still shouldn’t be a problem if that’s what it was for. Do they just do the check so they don’t get rapists, murderers, and drug dealers in their apartments? Also, i used to know the name of a site where you could look up free records and see what the person was charged with for free, but i cant find it, anyone know?

Hello, It has come to my understanding that juveniles in CA are able to seal their juvenile criminal records in CA when they turn age 18 OR if 5 years have past since the conviction. I know that we cannot seal our records if we committed an offense in WIC 707 (b), however, i ask this. Can juveniles still seal their records IF they got convicted with a FELONY rather than misdemeanor? Please help me, thank you for your time.

s the judge vacated the order and dismissed the charge against me. He also reinstated my civil and gun rights. It was a felony 6. In march 2007 I was arrested on suspicion of DUI. In July 2007 my lawyer got the DUI dropped and pleaded to misdemeanor reckless driving. I just graduated from college and am looking for jobs and some companies ask on forms if you’ve been convicted of a misdemeanor or felony other than a minor traffic violation. Would this reckless driving be considered a minor traffic violation, and will it show up on my background check?

I applied for a county job and have passed the wriiten test(I even ranked at #1) the oral interview and now the polygraph test. Next up is the background check which I am terrified over. I have debt anywhere from ,000-,000 which I am not proud of but its my reality, and Im worried this could halt my getting hired. I am contemplating just cancelling the rest of the hiring process or should I continue with it? Can this debt stop me from being hired? I did an application at PacSun the other day and I came across the typical ‘have you ever been convicted of a criminal offense’. Underneath it there was a disclaimer saying if you were in certain states (I think Utah was one) that you only had to check ‘yes’ is you had a felony, and said something along the lines that certain states dont check for misdemeanors.

I reside in Florida. I was cited with an Ordinance Violation 10 years ago (I was 17, which is an adult in the state of WI) in the state of Wisconsin. I paid a fine and never went to court or had any other repercussions. I was offered a job and they required me to submit to a finger-print background check. On the Background Check Auth and Release, it said ‘have you ever been or are you currently being tried for/charged with a misdemeanor or felony?’ so I answered ‘NO’ which is the truth either way since it isn’t even a misdemeanor on my background. I asked the clerk at the Municipal court and she said it is possible for it to show on a deep Background check BUT it would show as a citation, not a misdemeanor. At this point, what’s done is done and I am just curious of what others think. I am in the final stages of my pre-employment BG check. This company took my fingerprints to run an ‘FBI background check’. They, of course, didn’t say exactly what that means which, according to the FBI, is that they run the simply run the fingerprints to make sure they don’t pop up in that federal database. The FBI said they don’t do BGC’s for non-government companies, which makes clear sense. My specific concern/inquiry:

I raised two kids on my own,never ever received one dime of child support from there mother.Since I filed for chapter 7 bankruptcy,every time I have to have a background check I fail it.Why does credit issues weigh so heavy when it come to acquiring a job? The company i applied for asked for misdemeanors or felonies in the past seven years, in the job application. They have told me the job is mine if I can clear the background check. I have an INFRACTION (much smaller than a misdemeaanor) of "theft of property" which is almost 7 1/2 years old. Would this still affect me? Ive lost opportunities in the past over this (but it was only 2-4 years old those times) do you think a jewelry store will hire me, given that its not a misdemeanor or felony and is past 7 years? I have plead guilty to a summary offense retail theft (legally has about the weight of a traffic citation) four and a half years ago. It was a rough time for me as I was going through a divorce and my world was falling apart.
I never did anything like this before or anything like that after. I was a always a straight A student and have never tried drugs or gotten into any other trouble. Never even had a speeding ticket before.
Anyway, I kids go to a charter school. I am very involved in their lives, and I want to volunteer. According to Pennsylvania law, a background check must be done on anyway who is in the school including volunteers. I am really embarrassed about this and worry how this would affect the relationship that I have with the teachers and school. I also worry about my ex-wife somehow finding out.
Do these background checks just look for things like felonies, aggrevated assaults or child sex type offenses or are they on anything including my offense.
There are three levels of offenses in PA
1 Felony
2 Misdemeanor
3 Summary offense
Mine was the 3rd – I had to pay a fine and was on 2 months probation. I admittedly store 2 DVDs from a Kmart.

i was told that non violent felonies don’t show up for employment background check (unless they "really" dig or your running for city office). which is why some applications ask "have you been convicted of a felony in the last "x" yrs? is this true? i was convicted of a felony when i was eighteen, (eleven yrs. ago). i’ve been self employed since then but would really like to be employed full time. due i still have to put that i have a felony on all my applications?
i’m not saying that i would lie on my application, (i know that the dumbest thing u can do) but if there is some reason that that felony is not applicable then why mention it. also, i’m not saying that the felony is automatically erased from my permanent record (i know its there FOREVER), but just if the employer would see it.
oh..i also mentioned "some felonies" because obviously if it were murder or that nature than that would show up everywhere no matter how long.

Ok, so I was in Colorado, but I recently moved to Texas. A year ago, in Colorado, I was arrested for shoplifting. I took a plea bargain, and the charges were dismissed. I just got a job and they are doing background check. I said I have never been arrested for a felony or for a misdemeanor, because I was told that if your crime is dismissed, you do not put it down on job applications. Was I right to do so?

I had a bounced check about a year ago and a speeding ticket on my record, that was it. Due to this the company called me the day before I was supposed to start and told me that I was no longer eligible for employment. I just don’t understand how pre-employment checks are even legal? Isn’t that personal information that is none of their business? I can understand having a felony or even a DUI but not a bounced check!!!
So thank you to all the stick up-their-asses people that can’t understand why someone who, 7 years ago, when they were 18 and had just gotten their license, would have ever made a mistake. And by the way it was for a call-center customer service position.

When a job’s ad say’s "the ability to pass a criminal background check " does that mean they will NOT hire you if you have a felony on your record ,no if’s and’s or but’s about it ?

I had a drug related felony (PCS) about 5 years ago , I did drug classes and the judge dismissed the case. I guess I was convicted then the class was my "sentence" .
That is the only thing that would be on my record.
Wouldn’t they look past that more than they would say a VIOLENT background ?

Like i said, i think it was a level eight. First offense. They told me it WOULDNT be picked up by employers who perform background checks, but i just applied for a job and something came up. they havent told me yet but it has me worried. It happened when i was 17 and im now 21, turning 22 in less than a month. I wasn’t "convicted" of the felony but they used some other term, that i don’t remember. So if anyone could tell me the term and if it can be picked up in background checks id appreciate it.

I am going through a background check for an airline.
I was arrested a few years ago when I was a minor. The crime I was charged with was a felony, but I was never convicted. It was instead reduced to a misdomeanor disorderly conduct. A few months after that, the entire record was expunged. I was told that it was off my record forever and I didn’t need to answer yes on applications where it asks if you’ve ever been convicted of a felony.
Is there any possible way that the airline can see this?

I was falsely arrested 4+ years ago by the FBI for a felony, but was never indicted and charges were dropped. Will the arrest show up on a criminal background check by a potential employer? If so, what is the process of getting a record of this arrest expunged?

About four years ago, I was convicted of a felony but it was reduced to a misdemeanor after a year’s probation. What will show up on an employee background check? Will it just state I have a misdemeanor? And if so, will the cause of arrest remain the same?

Hello everyone-
I have applied at a financial institution for a Financial Advisor position and have spoken to one HR person who worked there. She informed me that when they do the Criminal Background Check for the U-4 with the SEC/NASD they only check back for the last 10 years. Does anyone know the specifics on this.
I was charged with a felony but got a Noli Prosqui, which basically got it off my records and I was never convicted but the charge itself I know is the only thing that can bar you from getting the security clearance for the U-4…which is forgery. I am praying it doesn’t come up.

my friend is dating this guy who has a felony for domestic against him. He says he never touched the girl but when i hear felony and domestic abuse there has to be some standing to it right? I just want to know what the police report says. So is there anyway i can look up a persons criminal record online and is there any place i can do this for free.

I recently interviewed for a position in NC in which I had to consent to a background check. About 15 years ago I was charged with a felony but went to court and had it reduced to a misdemeanor. On the application it only asked if I had been convicted of a felony so I checked no. They only asked me for my addresses for the past seven years so I am wondering if that is as far back as they will check my record or not? I kinda wished now that I would have told them about it but i did not know if it would show up plus I didn’t lie because I have not been convicted of a felony. I also recently had a background check to become a foster parent in NC and figured that if I passed that check which I did than I could this one too. The interview went really well and I think I have a great chance of getting this job but I just hope that I didn’t mess it up.

I was arrested for a felony but the DA is willing to drop it to a gross misdeameanor. I have gone to court but my hearing is extending until the end of next month. I am wondering what will show up on my background check if somebody runs one now? Will it show I was arrested and what for? Or that I am being charged with this crime? I have not been formally charged with anything yet or gone in front of the judge.

I was once given a warning by the police in Europe (while travelling), although I was neither taken to the police station nor to court. In US terminology, I was also not convicted/arrested/detained, etc, so I was not convicted with a misdemeanor or felony. They took down my details from my passport, but that was it. Does something like this show up in the background check for naturalization?

If a person has a pending felony in a superior court and a guilty plea has not been entered, and an employer does a background check, is the pending legal issue shown on the report? Is the pending alone a reportable event or does there have to be a guilty verdict?

I haven’t been formally charged yet so beneath the ‘DUI charges’ it says "*ALERT*-No convictions have been made as the the courts have not made any determinations on this case and court will continue on 6/1/09′ but my attorney is fighting this case and court has been continued 3 times now as i may have a chance of being found innocent (unusual circumstances, believe it or not a CHP officer hit me.. that’s right HE drove HIS car into MINE and of course they end up giving ME breathalyser and i came out at a .05 but i was only 20 and it was just a week or 2 before my 21st bday, as you can see the case is quite unusual) My attorney firmly believes this will all be thrown out. However I’m concerned at what showed up on my background check because a charge for a blood alcohol level of .08 or more shows as well as a charge of .05 and the courts have mentioned nothing about a .08 charge =[ and that ALERT notice shows under the charges. Will this hurt my chance of employment if i explain to HR before they decide they don’t want to hire me? NOTE: The position is for concierge/front desk at an apartment complex.
No felony shows. It says misdemeanor, but as i stated earlier it shows no convictions have been made. I did not mention anything about this pending DUI prior to the background check because i didn’t see it as an issue and didn’t think it would even show considering i haven’t been charged and my attorney is so confident about getting it thrown out.

I’m 22 now and I’m applying for a job, they asked if I had ever been convicted of felony OR misdemeanor and I do have a misdemeanor on my record that I was given probation for, which I violated once. I forgot to mention the violation of probation, are they going to find that on my record? I was under 18 throughout the whole thing.
BTW I’m in Florida and the arrest and probation also were in Florida.

Will this charge show up even though the conviction has been pardoned? It will be 7 years since the conviction in October 2008. What will the prospective employer see in the background check? Is there any way to remove it all together?
FYI, It is not homicide, a major felony or any perverted crime.

Does it always mean do not bother applying if you are a felon ?
Or is it just to let you know they will look into your past and does not mean they will not hire you if you are a felon ?
Or just to keep felons from applying ?
How do companies perform a background check ?
Would majority of companies (labor/warehouse/delivery) be more interested in a persons past employment history than a drug related felony from 7 years ago ?
It is my brother he see "background check" and does not even bother applying.

I had to go with my friend to her court case because she got a ticket for retail theft. She does not want to apply for jobs because she’s worried it will show up on her background check. She’s 17, and has heard that her youth file doesn’t get sealed until she’s 18.
Does it show up as a crime on her background check information?
And is that true about her file not being able to be sealed until she’s 18?
"yes it will show up but unless it was a felony it won’t show up"?
I think it was around or that she was charged with.
Who does she call to get it sealed when she turns 18?

well I applied for a new job and did a background check.. today i got the background check in my mail and it says i have a recond in "Public Record Search"
which says "Felony Including Misdemeanor (7 Year)"
and the court address that I remembered going to for my speeding ticket…
what the heck? does it mean I failed?
im a clean person.. never smoked, drugs, etc. as well as any crimes

Okay, what if someone has a felony that is over 12 years old, when you go apply for a job, (and this someone is a licensed professional) do you tell the prospective employer about the felony, do you put it on the application? Or, do you lie and say NO, and hope they don’t find out?
Oh, and how do you get rid of a felony on you background check that is OVER 12 Yrs. old… I mean people change, right?

I am currently trying to find a new job, but due to my background I have been unable to even get an interview. I currently reside in IL and am thinking about moving to FL and want to know if employers will find out about my record in IL? My last conviction was in 2001 for a felony and I also have two other misdemeanors from before 2001.

I want to know how far back the state of Florida can go to trace a criminal background. Is there a limit? My friend is moving here because she is struggling in Connecticut to find a job because her felony is following her. This was in 1989. She has no record since then. She is coming to Florida to try to start a new life. And I was curious to find out if anyone knew how far back they look when applying for a job. Thanks for anyone’s help! Really appreciate it!

I was convicted of driving with an invalid license, a misdemeanor, in 2008. Will this cause me to fail a pre-employment background check? The company (a law firm), seems strict. What are my chances that my misdemeanor will disqualify me from getting this job as a receptionist??? I need help, I’m really worried! Thanks!

The application asked if I have ever been convicted of a crime, "felony or misdemeanor". Then it states that havin a conviction doesn’t necessarily disqualify me from getting the job. It doesn’t state anything more about it.

I am considering law school, but got a felony when I was 18 years old (12 years ago) and am not sure if that would preclude my acceptance to the bar. I was told that no background check goes back further than 10 years, but I’m concerned that the fingerprint check for the moral and character fitness section of the bar may be more extensive. Any information would be greatly appreciated. Thanks.

I am out on Bail for false felony charges! My arraignment was on the 5th however was continued out until the 29th of this month.
As of now the DA still has NOT filed charges against me.
I was just offered a great job with a big company and was wondering if any of this will show up on the employment background check?
