I recently got a job offer at macy’s depending on the outcome of my background check. I recently just graduated from high school and i have no employment or credit history which is what they look for. My question is how long would it take for the results to come back considering my circumstances.

Legal action for an employer not verifying employment?

I understand that there is not specific legal statute against an employer who refuses to verify your employment, but if you were offered a job (orally), your background check came back clean and the only thing pending is for your former employer to response and verify employment, but they refuse to (boss won’t even return your emails/calls) mainly becuase you decided to leave his company and pursue a more satisfying career; can you legally sue your boss if your prospective employer takes back your oral job offer?

Expunged record appeared in an employment background screening. What can I do?

I received a great job offer from a couple that performed a post-offer background check. I was a victim of identity theft that resulted in criminal charges against my name. This happened nearly 10 years ago and I was never convicted of the crime and I was granted an expungement. The charges appeared in a background check that the third party company provided to the prospective employer. I provided them with a criminal record check from the Pennsylvania State Police stating that I have no criminal record but was told by the company they need to do additional investigation. They really want to offer me the job but corporate security hasn’t given the clearance as of yet. Can they rescind the offer if the corporate security tell them what I provided is not enough? It clearly states I do not have a criminal record so how can they hold what they found against me? I really want this job. Any serious advice is appreciated. Thank you

What do they really check for on background checks?

I got a job offer at Wal-Mart and now I am waiting to hear back from them after they do my background check. I have no criminal history, but I am worried because they said they check past employment, and I stretched the truth a bit about how long I worked at one place because the place went out of business. Can they tell that I did this?
The reason I said I worked longer at this place is because the place doesn’t actually exist anymore… it was a small business and it’s out of business now… so they can’t be called but can they pull up all my past W-2′s and see that I didn’t work there as long?

What can you do about a incorrect background check?

My husband was called by a potential employer for a pre-employment meeting regarding his background check. He had previously been given the job offer, already passed the drug screening. To our astonishment he was asked about a felony, that the Company they contracted to do the check, claimed they found, said it happened in Jan of 2001, stating it was a DWI with involuntary manslaughter that he was sentenced to serve 10 years, but only served 120 days. This is absolutely FALSE!!! My husband is an engineer and was in his senior year of college. We went directly to the Criminal Clerk of Courts and obtained a official sealed copy of his criminal record & w/only 1 small misdemeanor that’s from a traffic accident for failure to stop in 1994, thats all. Hes never ever, even had a DWI.
What in the world can we do to FIX this horrifying problem?

Help – Background Check !!?

I have got a job offer and now they are going to perform background check. Its not at all a problem, I have a very clean one. But the concern is when I submitted my resume, in the employment history I mentioned everything, every detail about where I worked, period of employment. But in the background check form, I missed one of the employers from history, because I left that company because of some issues with my supervisor. So far what I have mentioned in the background check form would come out well and positive. But will the employer/HR compare background check reports with the resume to see if I missed any employer in the background verification. Please help….

Radioshack employment background check?

Today I filled out a form (I got a job offer) to consent for a background check. On the paper it said it would check for criminal charges, blah blah, but also for previous employment and if they were fired and why they were fired. Well, my first job I was fired, and it’s really complicated why. Anyone who’s filled this out and been fired or been in a similar situation, will they see that? When I was fired, my boss was really nice about it and said he wouldn’t disclose it. I’m so scared, I really need this job, what will happen?

Is it normal for a job to offer and welcome you aboard before conducting a credit, criminal, background check?

A bank extended me a job offer, which I accepted and they gave me a start date, pay rate and training information. They told me that they’re going to conduct a criminal, credit and background check, which is fine with me however, I have HORRIBLE credit:(

What should I do when a company I have applied for employment asks for my date of birth for the background chk

I filled out an application for a job today and had an interview. I signed a release to do a background/credit check. They asked for my date of birth on that release form. I left it blank. I havent been offered the job, I was only there for my first interview. I know that a backround/credit check can be done without a birthdate, and dont they wait until thett are least seriously considering hiring you, or have actally offered the position before a background check is done? Is asking for the birthdate on the other form just a sneaky way of finding out how old you are prior to offering you a job???
I realize they need the age info if you are hired, but I only filled out an application, and had a 10 minute interview.Isint it against the law to ask someones age before a job offer??Do the do background checks on everyone who fills out an application?

how long does walmart's background check for employment take?

Ok, last thursday I got job offer with walmat as a cahier. I also let them know that I have a mesdimeanor that I commited in 2009. the manager said a background check has to be done. He said it could take up to 2 to 3 weeks. I thought they take only couple of days. I know that there are some people that work at walmart that have mesdimeanors so I’m guessing I can still pass the background check with one mesdimeanor

Employment Back Ground Check???

I work for a well known financial advising firm, they want to offer me a full time position and hire me on the team. I have to fill out all this information on my background/education/employment and several financial questions. I’m licensed in insurance, have my series 7 and 63 so I’m not worried about any of the financial or criminal background checks. However I had a couple of jobs that I just walked out on, and pretty muched burned my bridges. Just to make it clear I was not fired, but I know they contact all my employers to verify, pay, duration of employment, and rehire status. Should I leave those 2 jobs out, and will they know? From my understanding they are only going to look at what I put down, and for the gap in employment I would just put stay at home dad, since I do have a child. I really hate to lie, but putting that info will most likely cost me a job offer….It would be about a 6 month gap.

Pre-Employment Credit Check?

Hi Lawyers…Please HELP!
Needing some help please. I recently received a job offer for a Practice Management position after 3 months, 6 interviews and 5 references were provided. I was scheduled to sign contracts this week to begin working next Monday. However, the employer in a last minute turn of events, asked the recruiter to run an employment background check and credit check on me. The recruitment agency contacted me via phone and left a voice message asking for my consent to run these reports. I responded through email saying to go ahead but that I had a prior bankruptcy that occurred in 2005 that I felt sure would be an issue for the employer. The recruitment agency then called me to ask me if I was interested in divulging any details about this as they also felt sure she would "freak out" and have questions. I explained in brief that it was due to medical bills and opted to say no more.
I then spoke to my HR guru friend who told me that the law states any credit check has to be requested via a signed consent form. I quickly called the recruiter back to halt the process as I was also advised to not do it as these things are often very sketchy and not relevant. By the time I called to stop the process and state this was highly suspect, it was too late. The reports were run and the results related to the employer via a phone call. They assured me in a written letterhead document that no hard copy was sent to the employer nor had they kept the documents on file as they were not obtained legally and correctly.
As expected, the employer now is very upset by the bankruptcy. She feels she cannot trust her 2.5 million dollar practice to person with such a questionable history. That would be me. Yes, I’m furious and very very hurt. My background check is perfect..not so much as a speeding ticket. I’ve never been arrested, have felony convictions, etc. Nothing. Further, as previously stated, I have endured a marathon of 6 interviews and provided 5, yes 5 references..all stellar. She now wants to hold off on any decisions of employment pending some questions she now wants to ask me regarding the bankruptcy.
I am angry and feel discriminated against. First off, I understand that the collection of this data was not legally obtained. Further, I also know that asking me personal questions of this magnitude is also walking a thin line of legal correctness. If you can’t ask a potential employer if they are married or have kids, then how can you pry into their personal financial history and make that person justify themselves?
My question is obvious I guess: Do I have a legal case? And should the employer opt to forgo employment with me even though an offer was presented to and accepted by me, is this more of a case for discrimination?

@ WRG: Actually, no. It is not legal to attach credit check forms to applications for employment. This is a separate document that must be separately signed and a copy given to the applicant as well as kept on file in the employment office.
Further, I do not have bad credit, I have a bankruptcy 6 years ago. Nothing else is in question.
Finally, a verbal authorization does not preclude taking legal measures to ensure I am protected and the employer is protected. It’s a 3 part process: first is the signed form stating you understand a credit check might be performed. Then if the employer decides to pull the credit check, they must have an employee sign another statement giving consent, then if employment is denied based upon that credit check a copy of the credit report and a document stating the reasons why employment was denied must be given to the applicant. Verbal or not, it’s not legal.

will a warrant for failure to appear in court appear on a CRIMINAL background check?

I am applying for a management position at Qdoba Mexican Grill. I am going to get a conditional job offer and they will run a CRIMINAL only background check. I believe I have a warrant for a traffic ticket I did not pay and missed my court date on. Will this show up on my background check or keep me from getting this job? How should I handle this situation?

What is covered in an employee background check?

I have been out of the job search market for quite someone. In fact, I have been at my most recent position nearly six years. Recently got a job offer and they are just going to do the background check. I am just curious what this covers. I am a legit person, education and job history – all honest and correct, no criminal record, no history of civil suits but I have less than perfect credit. Do you think that less than perfect credit disqualifies you for a job?

Can Job Centres 'force' unemployed individuals into a job they don't want ?

especialy if the individuals hold qualifications such as a degree, HND, A-Levels, Btec or other relavent rcognised certification – can they like, throw you on the streets and make you sweep roads ?

I have a degree, abiet a not very good one – but its a degree.

Also I have a GNVQ in Advanced Science (with pass) and an A Level at grade D.

I also have the equivalent of 8 GCSE’s under my belt, 4 of which are C’s and one grade B.

I have next to no work experience though – my last job was 8 years ago and i was 2 hours short of being registered a full time employee, although I suspect my employers at the time registered me as one nonethelss.

I wonder if Job Centre people can dirty up your name if you refuse to do work they bully you into doing, i.e somebody like me being asked to work at KFC or be a Car Park Ticket Warden (something obviously uncomplimentary to my educational background and worth).

can they bully and intimidate me into a line of employement I dont want to go into – bringing me to my final question, i will take my goddamn time to find suitable work for myself – but that will mean staying on JSA for a while unfortunately. Ive been paid twice so far and expect to be paid JSA again today.

Can the Job centre folk dirty up my name, history by informing the government over the telephone that ‘hes not accepting the job offer we gave him – he wont work at KFC’ , and then get the police to break down my door and beat me up over it ?

i dont want to get a criminal record because I didnt comply to bullying by job centre people.

How long does it take Comcast to do a background check and employment verification?

So here’s the deal… I applied for a job with Comcast awhile back. They called me in for the Assessment Test and I passed. Did the interview, pass. The lady from Human Resources called me in last Wednesday, 2/24, to do some more paperwork. While looking at all the paperwork she told me that this was a "preliminary" job offer pending drug test and background check/past employment verification. I had 48 hours to take the drug test but figured why not and took it around lunch that day. I have nothing to worry about on that end anyway. Then later that night, people from another company started calling asking for W2′s,1099′s, pay check stubs, diploma, etc. saying it was to check my employment verification. I sent it back in and one of my old employers called me about 2 days later and said they called his office and he left a good reference and all the info matched. Then an old client said they were trying to call her but she couldn’t answer because she was at work. They left a number for her to call and she would call it back but couldn’t get an answer. This went on for about 2 days. My HR lady told me that they drag their feet and it’d probably be 2 weeks before I could start. Here’s my thing though… Nobody has called me from Comcast or the company doing the background check. I can’t get in touch with either of them also. I have no criminal history whatsoever. If there is an issue would they at least call me to resolve it or just never call again? Or is no news good news? It has me kinda on edge. I guess from just sweating it out day to day and the fact that I have a 9 month old son and a fiance and this is the first good paying, legitamite job offer I’ve had since I got laid off last year. Has anyone else been through this? Am I just overreacting or is there something I should be worried about? Thanks

background check investigation for employment?

A potential employer recently mad a job offer contingent on a succesful background check. I took the urinalysis two weeks ago and that is when the background check started. I havent heard anythin gyet and my schedule start date is May 29th. If there were a problem would they have contacted me by now. Should I think that no news is good news. They said it takes 7 to 10 days for the check to come back and it has been 15 days.

Do government jobs check IRS or tax records in their pre-employment background investigation?

I’ve recently accepted a job offer with a governmental agency, and I’m curious to know if they do or allowed to check IRS or tax records in their pre-employment screenings. I was once told that searching IRS/tax records was prohibited by the 4th amendment (unlawful searches and seizures) but I’m unsure. Any help?

I am not looking for a driving job. Also, I was given a job offer recently, contingent on background check and references. I just got a call rescinding the job offer because of corporate restructuring. I suspect it could have been due to the DUI on background check done by a third party. Will I pass my employment background check if…?

I just received a conditional job offer contingent on my background check. The last internship I had ended on bad terms. Myself and some other interns quit the internship a month early via email. If they talk to my "supervisor" I know she will say bad things about me. I also did not tell the interviewer that I QUIT the position, but they do know it is over and the start and finish dates. All of my other employers would give me rave reviews, but its just this one that is the most current that I am worried about. Is it possible that I might fail because of this?

I have got a job offer for a position and they are doing a background check on me. I have bad credit, but the reason why is about 8-9 years ago I got into some credit card debt. Just curious…when a job offer is made contingent upon the successful completion of a criminal background check and favorable references from your previous employers, which would they complete first? HR professionals, I welcome your input!

I applied for a job and was hired on and told them in the interview that I have my diploma when in reality I have my G.E.D. I also informed them that I was giving my current job notice but actually quit with no notice. My credit is good and driving record is good.
