I have been offered employment at what I consider my dream Job. This employer has the standard application, which asks a difficult question regarding background and misdemeanor and or felony possession. I have a misdemeanor of moral interpitude, which I am not proud of; never the less it is a blemish.
My dilemma is a catch 22 of sorts. If I disclose my background, I hurt my chances to further negotiations. If I choose not to disclose it is considered a lie and I can be let go if a background check comes back negative.
Here is the question, how can I best address this issue and keep my head up high??

So, a couple of years ago, I plead guilty to a charge of "unlawful possession of marijuana" in new york state. I was caught again (dumb youthful choices on my part, I know) and this time it was reduced to "disorderly conduct." Both are non-criminal offenses (violations…less than a misdemeanor. the infractions are in the same category as traffic violations).
Now, I may be looking to get a government job in the next couple of years (biostatistics). Could this hurt (eliminate?) my chances of ever working for the government? Or even any private company anywhere?
Now I know that if someone were to ask me "have you ever been convicted of a crime?" I can truthfully answer "no I have not" though could these things show up and cause red flags on a background check and prevent me from obtaining a good job, whether it be for the government or anywhere else?
I was over 18 at the time this happened.
I know the record won’t disappear. What I’m really concerned about is how much this may affect my "employability" in general. Would it be possible and/or likely an employer could offer me a job and then revoke the offer because 5 or 6 years ago I had a couple arrests related to marijuana possession?
Possession of marijuana in New York is NOT a crime, so why would I admit to being convicted of a crime if I haven’t been?

Here’s the deal…I was a heroin addict for 6 yrs. (been "clean" for 3 yrs. aside from very rare use/twice a year). During my addiction I was lucky enough to have NEVER been arrested for anything…except a misdemeanor, domestic dispute/ argument w/my sister. I was arrested, but also released same night (because I didn’t have a record).
After going to court months later, my only sentencing/punishment was to "remain in drug treatment/stay clean" because by the time I had to appear in court for the domestic dispute, I was already in treatment (which I DID finish successfully within 2 yrs. of methadone treatment).
My question is, do employment bckgrnd. checks disclose the "outcome"/sentencing of legal charges? Will this "check" show that I was required to finish drug treatment/had an opiate dependency? Sadly enough, I have a college education,always held a clerical/desk job, never had ANY legal issues (aside from this), and started using heroin at 21yrs old. I don’t want my employment opportunity to be "judged" upon my past/past medical issues (addiction is a disease, is it not). So Just how much does this background "check" disclose?

My husband was called by a potential employer for a pre-employment meeting regarding his background check. He had previously been given the job offer, already passed the drug screening. To our astonishment he was asked about a felony, that the Company they contracted to do the check, claimed they found, said it happened in Jan of 2001, stating it was a DWI with involuntary manslaughter that he was sentenced to serve 10 years, but only served 120 days. This is absolutely FALSE!!! My husband is an engineer and was in his senior year of college. We went directly to the Criminal Clerk of Courts and obtained a official sealed copy of his criminal record & w/only 1 small misdemeanor that’s from a traffic accident for failure to stop in 1994, thats all. Hes never ever, even had a DWI.
What in the world can we do to FIX this horrifying problem?

At a low in life I made a bad choice and was convicted of a felony. The felony was eventually reduced to a misdemeanor and then the misdemeanor was expunged. Hello, It has come to my understanding that juveniles in CA are able to seal their juvenile criminal records in CA when they turn age 18 OR if 5 years have past since the conviction. I know that we cannot seal our records if we committed an offense in WIC 707 (b), however, i ask this. Can juveniles still seal their records IF they got convicted with a FELONY rather than misdemeanor? Please help me, thank you for your time.

i asked this question last night but didnt get the answer i wanted so here goes again. I have two driving charges vc.23103 and vc.23140 one being a infraction and one a misdemeanor. i recently had these charges expunged but according to the clerk at the court these charges still remain on the record but will say "dismissed". now what i’d like to know is am i suppose to mention this to employers or just answer "no" when it asks if i’ve ever been convicted of a crime.
the word thats usually used is "convicted" which means that i was found guilty. i was found guilty for both charges but since the charges were expunged and now say "dismissed" next to them would i still have to mention this on applications?

The misdemeanor was when i was 19 and got pulled over with alcohol. they dismissed the case and i didnt have to pay a ticket or even see a judge or anything. i applied for a job and nailed the interview (im 20, gonna be 21 this year) and wanted to know if its gonna come up on the background check. In march 2007 I was arrested on suspicion of DUI. In July 2007 my lawyer got the DUI dropped and pleaded to misdemeanor reckless driving. I just graduated from college and am looking for jobs and some companies ask on forms if you’ve been convicted of a misdemeanor or felony other than a minor traffic violation. My boyfriend and I were trying to get an apartment but we were declined becuase they stated his criminal records show he commited a misdemeanor (assult). He has not ever been arrest or had any criminal problems and had never even lived in the city were the crime was commited. There is a great chance his brother did it since he has had problems in the past but he said he did not. My husband is applying for a job at a bank and in the application it says that they perform a background check through the FBI. When he was younger (16), he got in trouble in a different state and got a misdemeanor on his juvenile record, which is now presumably sealed. Is this going to show up on this background check? He has never had an issue with it before when applying for other jobs, but we figured the bank would do a more thorough check.

Will an ordinance violation, classified lower than a misdemeanor, show up on a fingerprint background check?
I reside in Florida. I was cited with an Ordinance Violation 10 years ago (I was 17, which is an adult in the state of WI) in the state of Wisconsin. I paid a fine and never went to court or had any other repercussions. I was offered a job and they required me to submit to a finger-print background check. On the Background Check Auth and Release, it said ‘have you ever been or are you currently being tried for/charged with a misdemeanor or felony?’ so I answered ‘NO’ which is the truth either way since it isn’t even a misdemeanor on my background. I asked the clerk at the Municipal court and she said it is possible for it to show on a deep Background check BUT it would show as a citation, not a misdemeanor. At this point, what’s done is done and I am just curious of what others think. When you fill out applications for employment they always say list all arrests/convictions on your record within X number of years. How many years is it in Illinois? What state has the shortest time frame for looking back on criminal records? I have a reckless driving charge on my record which can never be sealed or expunged under the new 2010 laws in illinois and I do not want to ruin my future employment opportunities over trying to hide a misdemeanor.

I am in the final stages of my pre-employment BG check. This company took my fingerprints to run an ‘FBI background check’. They, of course, didn’t say exactly what that means which, according to the FBI, is that they run the simply run the fingerprints to make sure they don’t pop up in that federal database. The company i applied for asked for misdemeanors or felonies in the past seven years, in the job application. They have told me the job is mine if I can clear the background check. I have an INFRACTION (much smaller than a misdemeaanor) of "theft of property" which is almost 7 1/2 years old. Would this still affect me? Ive lost opportunities in the past over this (but it was only 2-4 years old those times) do you think a jewelry store will hire me, given that its not a misdemeanor or felony and is past 7 years? How far in depth does a background check go into?? I mean, its not like i’m applying for the police department or something… Heres the thing, Exactly one year ago, I was DETAINED ONLY for misdemeanor vandalism. The person never pressed charges cuz it was my friend. We were drinking at the club, i was outside, waiting for everyone to come out, the police were pushing everyone aside to move along, i was leaning on my friends rearview mirror and it broke off. I then copped an attitude with the police officer, and he ended up hauling me off to the nut-house for the night. When i went to court for my scheduled appearance, the person told me that I didnt have to be there since charges werent pressed, however; if my friend wanted to, he had up to a year to take action. Nothing happened. Now i just applied at this place, all i’m waiting for is my background check. What are the chances that this little incident will show up???

I have plead guilty to a summary offense retail theft (legally has about the weight of a traffic citation) four and a half years ago. It was a rough time for me as I was going through a divorce and my world was falling apart.
I never did anything like this before or anything like that after. I was a always a straight A student and have never tried drugs or gotten into any other trouble. Never even had a speeding ticket before.
Anyway, I kids go to a charter school. I am very involved in their lives, and I want to volunteer. According to Pennsylvania law, a background check must be done on anyway who is in the school including volunteers. I am really embarrassed about this and worry how this would affect the relationship that I have with the teachers and school. I also worry about my ex-wife somehow finding out.
Do these background checks just look for things like felonies, aggrevated assaults or child sex type offenses or are they on anything including my offense.
There are three levels of offenses in PA
1 Felony
2 Misdemeanor
3 Summary offense
Mine was the 3rd – I had to pay a fine and was on 2 months probation. I admittedly store 2 DVDs from a Kmart.

I am wondering if there is any definitive crime classification that entirely disqualifies someone from becoming a politician, such as some misdemeanor, some felon, or even a bad military discharge, like other than honorable, or a bad conduct discharge. Or is the process entirely up to the people who elect to decide his fate. And what do you think…

Ok, so I was in Colorado, but I recently moved to Texas. A year ago, in Colorado, I was arrested for shoplifting. I took a plea bargain, and the charges were dismissed. I just got a job and they are doing background check. I said I have never been arrested for a felony or for a misdemeanor, because I was told that if your crime is dismissed, you do not put it down on job applications. Was I right to do so?

I am a student pursuing a degree in finance and am beginning to seek employment at a financial institution in order to gain experience in the field. However, I have been convicted of misdemeanor corruption of minors at the age of 18 during my senior year of hs. It has been four years since I committed this offense and I have taken some steps in the right direction. I have maintained a very high GPA and have been involved in various campus organizations at school. My ultimate goal is to seek a pardon several years down the road, assuming I have no future arrests, of course, but I do not know how much my criminal background will affect my current job prospects. I was "charged" with criminal harassment in Jan 2010, with and ordered to pay a total of 0 by Jan 2011. My first probation was Feb, 2nd is in April. I’m currently unemployed and trying to find a job, how will this show up on an employee background check?
This happened in Mass., and I went to a probable cause hearing then to an arraignment, both with an attorney.
I was never formally arrested or fingerprinted. A summons was sent to me via USPS for an show cause appearance where there was enough evidence to go forward with an arraignment. At the arraignment my attorney spoke to the prosecutor before the arraignment.
My probation officer said that it will show up as a misdemeanor for criminal harassment, and to just say that it was an dispute with a neighbor, it was a lack of communication and it’s been resolved. The truth of the matter is that I was sending mailings and subscription to a person that my husband should not have been friends with.(to make a long story short without getting into any depth or detail)

Will a background check or arrest background show the comapany, people etc. that filed the warrant of arrest or was indicated on the warrant? Does their name come up with the charge or is it the charge alone? Example: I had two felonies one obtaining by false pretense or token cash beloning to John Doe and valued at more than 0.00. The second was steal equipment valued at two hundred dollars or more and belongs to company ABC. The first charge was dropped completely ( obtaining by false pretense) and the second was reduced to misdemeanor (disorley conduct). happend in apr 2005. been clean since. petition for expungement was granted.
now i’d like to know what do i do when appyling for jobs. from my understanding is that these charges will still be on my record but will say "dismissed" since it was expunged. but does that mean i can answer "no" on applications?
had several interviews, filled out paperwork, background check consent forms, ect and after that i never get a call back from them. when i call to follow up they say the position has been filled which i think is bs and unprofessional of them not to call back and at least let the person know whats going on.
anyway i was fired from my last job for lying on my application and i dont want to make the same mistake twice. so what is the best way to approach this. any advice will be greatly appreciated thanks.
The word most employers use is "convicted" which by definition means that i was found guilty. i was found guilty but the record says "dismissed" still a little confused about that.
the position was temp-to-hire so after 6 months of temp work. they decided they liked me and wanted to make me permanent. i filled out another application from the company not from the temp agency and that is where i answered "no" that i was never convicted
sorry forgot to add one more thing. even though they are EOE that doesn’t mean they won’t lie and say the position has been filled or never call you back. like you said they dont have to hire anyone they dont want to

I recently interviewed for a position in NC in which I had to consent to a background check. About 15 years ago I was charged with a felony but went to court and had it reduced to a misdemeanor. On the application it only asked if I had been convicted of a felony so I checked no. They only asked me for my addresses for the past seven years so I am wondering if that is as far back as they will check my record or not? I kinda wished now that I would have told them about it but i did not know if it would show up plus I didn’t lie because I have not been convicted of a felony. I also recently had a background check to become a foster parent in NC and figured that if I passed that check which I did than I could this one too. The interview went really well and I think I have a great chance of getting this job but I just hope that I didn’t mess it up.

i uninetionally failed to stop for police while i was going to work… i pleaded not guilty but was convicted and paid a 100 dollar fine…. the offense went down as traffic misdemeanor… it was my only trouble with the law in my whole life…. will it show up on my criminal background check? first and only time misdemeanor…….

I was once given a warning by the police in Europe (while travelling), although I was neither taken to the police station nor to court. In US terminology, I was also not convicted/arrested/detained, etc, so I was not convicted with a misdemeanor or felony. They took down my details from my passport, but that was it. Does something like this show up in the background check for naturalization?

I will also have to be bonded, so I imagine the background check will be very complete. I had an FBI background check almost 3 years ago, and the charge showed up (despite being told that it would be expunged upon completion of community service program).
I’m very concerned, I’ve already been hired and am considering telling my employer in advance. Given the trust-based nature of this position, I am afraid that this will negatively affect their decision (understandably so).
Will it show up, and if so what are the chances of this affecting my employment status? It was a juvenile misdemeanor shoplifting charge, almost 11 years ago, and it is currently in the process of being expunged.
What should I do??

I haven’t been formally charged yet so beneath the ‘DUI charges’ it says "*ALERT*-No convictions have been made as the the courts have not made any determinations on this case and court will continue on 6/1/09′ but my attorney is fighting this case and court has been continued 3 times now as i may have a chance of being found innocent (unusual circumstances, believe it or not a CHP officer hit me.. that’s right HE drove HIS car into MINE and of course they end up giving ME breathalyser and i came out at a .05 but i was only 20 and it was just a week or 2 before my 21st bday, as you can see the case is quite unusual) My attorney firmly believes this will all be thrown out. However I’m concerned at what showed up on my background check because a charge for a blood alcohol level of .08 or more shows as well as a charge of .05 and the courts have mentioned nothing about a .08 charge =[ and that ALERT notice shows under the charges. Will this hurt my chance of employment if i explain to HR before they decide they don’t want to hire me? NOTE: The position is for concierge/front desk at an apartment complex.
No felony shows. It says misdemeanor, but as i stated earlier it shows no convictions have been made. I did not mention anything about this pending DUI prior to the background check because i didn’t see it as an issue and didn’t think it would even show considering i haven’t been charged and my attorney is so confident about getting it thrown out.

I’m 22 now and I’m applying for a job, they asked if I had ever been convicted of felony OR misdemeanor and I do have a misdemeanor on my record that I was given probation for, which I violated once. I forgot to mention the violation of probation, are they going to find that on my record? I was under 18 throughout the whole thing.
BTW I’m in Florida and the arrest and probation also were in Florida.

Recently had to re-apply for my job and erroneous information appeared on my background check about a possible conviction record misdemeanor class. I have never been arrested! a failure to appear in a traffic court because of a traffic ticket that was put on a person’s DMV record by mistake by the court house and /or dmv, would that show up on your background search when you are looking for a job? (a failure to appear in a traffic court, in California is considered a misdemeanor)
Second, if your car was repoed, would that show up as a judgment or something or some kind of court order or law breaking act , that could show up on your credit report, or background report for employers to see ?

I have a criminal record that is 7 years old. It has since been expunged/sealed. I need to fax that information to background check companies so they can update their records
7 years ago i had a misdemeanor placed on my criminal record. I know that you can legally deny it but the background check still shows it. I had my record expunged. But it still shows up. That is why i need the list so i can have them update their records.

well I applied for a new job and did a background check.. today i got the background check in my mail and it says i have a recond in "Public Record Search"
which says "Felony Including Misdemeanor (7 Year)"
and the court address that I remembered going to for my speeding ticket…
what the heck? does it mean I failed?
im a clean person.. never smoked, drugs, etc. as well as any crimes

in the beginning of 2009 … say 2/01/09. And, there is a misdemeanor or two that happened and is on my record at last date of 3/2003. Will it show up? I don’t think it would, but how about if they do a five year on 5/2008 will the offenses show up from 3/2003

The application asked if I have ever been convicted of a crime, "felony or misdemeanor". Then it states that havin a conviction doesn’t necessarily disqualify me from getting the job. It doesn’t state anything more about it.

My friend, who is a US Resident, recently got married and is trying to change her last name to her husband’s last name. On her 18TH birthday she got into some legal problems and earned herself a misdemeanor which she subsequently had expunged. I am aware that she has to inform immigration of this, even though she has had her records expunged, but what I am baffled about is what does her criminal history have to do with changing her last name to her husband’s last name? Can she actually be turned down because of her past activities? It is not as if she is petitioning for her citizenship or anything.
INS sent her a letter today informing her of her appointment date and requesting that she provide information, if any, on any arrests or criminal activity in the past. What bearing does her past activities have on her requesting a last name change and can her request be denied? She is concerned and thinking of just keeping her last name the way it is now that all of this is happening.
I can’t figure it out because I am not familiar with INS and their rules and regulations. I can figure out why a criminal record would be important to a request for Citizenship or Residency, but, no, I actually can’t figure out why her past criminal history would have a bearing on her accepting and subsequently using her husband’s last name. If last name could possibily be an issue then immigration should also have an issue with residents getting married. Getting married and accepting your husband’s last name are synomous with each other.
I actually don’t feel bad that I don’t know. If everyone knew eveything – Yahoo Answers would not be necessary and no one would be using it not even you.

I have been pulled over for traffic infraction but the police never said anything.
